What do people think of this punishment?

Derek Eli Madsen, the 28-year-old Veneta man who unintentionally shot Jesse Solomon McLaughlin last October, had no answer.


Complete and total negligence.

For what he did, I think he deserved much more punishment.

There's gotta be some deterrence to going around shooting people in the neck and making them quadraplegics.

I do not believe the shooter's story for a single minute.

(1) The man's DRIVING down the rural road in a Jeep, with his girlfriend

(2) Claims he thought he saw a SKUNK

(3) STOPS the Jeep, jumps out intending to shoot his .17 caliber weapon at he claims was a SKUNK

(4) Pulls the trigger, crippling the Paintball shooter.

Here's what I think happened.

(1) A genuine, true to life jerk (who resembles a certain part of my hidden personality way too much) knows people shoot paintballs in a rural area.

(2) He sees one, and decides that it would be really fun to hurt the Paintballer with a .17 rifle

(3) Stops the Jeep with every intention of hurting someone, though obviously not wanting a permanent injury. Nobody would generally plan that. No, he just wants to cause some pain and laugh about it as he drives quickly off in the Jeep.

(4) Ends up in court, claiming that he thought he saw........a skunk, which as everybody knows, if you're driving down a road in a Jeep, you have to stop and shoot it.

Some total idiot harms or kills someone (or allows it to happen to their child!) it’s always “they’ve suffered enough”.
Criminals use a gun? People blame the gun and/or society.
But let a citizen use a gun against a criminal and he will be crucified by the press. And by the courts too, in some states.
Something is terribly wrong with this picture.
 
Bruce, it's worse than that...

He didn't get out of the car before shooting. The story stated that if he had, he would have heard the people moving around and the sound of paintballs. He was in such a hurry that he just shot from the car. That was noted at the trial.
 
Madsen pleaded guilty Monday to felony assault with a firearm in exchange for three years on probation, 150 hours of community service with the physically disabled and in gun safety classes, and a $20,000 payment to Jesse McLaughlin.


To be truly remorseful, Madsen would have to spend the rest of his life paying for Jesse McLaughlin’s care because it is unfair to expect the victim’s family and community to pay the bills, Joe McLaughlin said.

“Where is the justice in that?” he asked.

Madsen should gracefully give a percentage of each paycheck in order to cover McLaughlin's care for the rest of his natural life.

The grandparents of the guy that got shot are friends of my grandmother, so I heard about this when it first happened. Far as I'm concerned, the shooter got off very light.
 
This sounds like something I would read in the Onion. Is the shooter well connected?
 
This is why people shooting from vehicles on roads should make sure of their target. Same thing happened to a boy out hunting duck in Emporia, Ks. not to long ago, except he died.
