Woman warned grandson about robbery before he died while robbing

    State Wire
    April 5, 2005 0405BC-WI--FATALROBB

RACINE, Wis. (AP) - The grandmother of a 20-year-old man who was shot and killed by a man he was trying to rob said she's not mad at the man who shot him.

"My grandson knows what he did was wrong," said Elizabeth Lockridge-Lewis, who raised Kendell L. Moss, 20. "I do not up and hold with no wrongdoing. I try to raise my kids up to do nobody no harm. I try to be mad at that man, but I can't. "

She said she told her grandchildren Saturday about the dangers of stealing.

"I talked to all of them that night about how people do to people that steal something," she said. "They kill you."

Less than 12 hours later, Moss, her oldest grandson, was dead and four of her teenage grandsons were in custody in Milwaukee.

The five took her van early Sunday morning, she said.

Moss had asked to take it earlier, but she refused. She thinks they may have peeled the steering column.

Milwaukee Police Department spokeswoman Anne E. Schwartz said the cousins drove the van to Milwaukee, where they attempted to steal a second car at a gas station.

Schwartz said the group approached a 64-year-old man from Yorktown, Ark., at about 6 a.m. Sunday.

One of them had a gun and they demanded the man turn over his van and money.

The man refused, Schwartz said, and Moss and his cousins began punching him. The boys then took the man's walking cane and beat him with that, Schwartz said.

At that point the man took out a gun and shot Moss, Schwartz said.

Lockridge-Lewis and Moss' father, Darron Moss, said the incident was out of character for the young man.

"I feel that the guy had options," Darron Moss said. "He could have shot in the air or screamed and scared them. You can replace things stolen, but not a life."

Police still had the four teenagers in custody, Moss' family said Monday. Police would not release their names because they are juveniles. The Arkansas man was arrested.

The Milwaukee County district attorney's office was reviewing the case

Grandma's got some sense, but the boy's father sure as heck doesn't.... These kids are beating an old man with his cane, and Poppa says the man should have "screamed and scared them"? I'll try to chalk it up to shock on the father's part, but I know that's probably not it.

First you get beaten by 5 people, then the police get there and finish the Mugging!!!!!!!!

The poor guy should be given a medal for helping clean the gene pool instead of a court date!!!!!!

It is no wonder that crime continues when the political system works to hold people helpless so the criminal doesn't get hurt.

What the hell?!? A 64 year old man gets beaten by his 5 guys, one which is armed with a pistol, and HE GOES TO JAIL for shooting ONE OF THEM? He shoulda reloaded and given them one each in the kneecap of their choice.

Perhaps the 64 year old man from arkansas was arrested for carrying a concealed weapon (does WI have reciprocity with arkansas - assuming he had a CCW license).

AR permits are NOT honored by WI. I always thought there was something called "extenuating circumstances", that meant if you had to use a weapon in self-defense, you couldn't be charge for simply possessing it there. I've never counted on it, as I've not seen it written, but several people around the range have spoken about it.

^ unfortunatly, that's what I understand to be the case too. I have a GA permit and many in-laws in WI. I don't carry on my person when I visit.

This is the perfest example of "It is better to be judged by 12 than carried by six". At least in court he will be alive to tell about it. If he hadn't broke the law he may not.

If they were trying to take his car may be the gentleman had his weapon on the seat or in the console.

That wouldn't be concealing a weapon.

The victim from AK was arrested for the shooting and the loaded firearm in the car.

He sat in jail for 48 hours and was releasesd as the Milwaukee (The "boys" were from nearby Racine to the south, and were in Milwaukee when their Grandmother's van died...) DA's office declined to press any charges against the victim for obvious reasons. Even the tecnical firearms violation he comitted was ignored.

The local conservative/pro RKBA set is outraged the man was even arrested. The main reason most of us think he was booked was that the attack ocurred at 6AM on Sunday, and the investigating MPD detectives had thier shift change coming up. They could book him and go home, or they could stay past thier shift and keep the poor man company at the station while they sorted things out. :( The official explanation was that he was out of state, and that he was therefore automatically a "flight risk" while the investigation was being conducted. (What? Hobbling back home to AK at .08 mph on his broken cane? )

The surviving perpetrators ("surviving perpetrators" Has a nice ring to it, no? :D ) are still all in detention. Since they're juviniles, getting public info on thier stauts is difficult under shield laws...

For anti-carry WI this is a pretty good outcome, all things considered. We're approching civilization, albiet slowly here. We're now where Ohio was a few years ago before thier CCW passed. Due to recent State Supreme Court decisions we now exist in a de-facto "affirmative defense" state where "illegal CCW" is not prosecutable, at least in theroy, for an otherwise upstanding and law-abiding person.

I think those of us stuck in WI get CCW eventually, It's just going to take time in this rather backward state of ours... :scrutiny:

NO, your punk thug kids had options, option: Dont have your head so far up your anal region that you are beating and attempting to steal from someone. You may get away with it, or you may end up dead. 1 oxygen thief thug dead, many more out there.

It's a good thing that they got that 64 year old scum bag off of the street. Now we will need to ban assault weapons, and the world will be a better place.

And I bet you don`t live in California! Remember, a Judge can tell a jury what to think. At least Judges do in California. :banghead:

DarkKnight01, Milwaukee, Madison and Racine are the most populous cities in the state, and they control the politics.

We also had a Republican governor who didn't want such a controversial bill to be placed on his desk, assuming a Democrat-controlled legislature would even allow such a bill to pass. We now have an extremely anti-gun governor who will veto the bill everytime it comes up.

You guys who are mad about him being arrested, he killed a person. He is a killer. At a trial I hope the man proves self defense, but I doubt he will go to trial. He was arrested because that is what the police do. The police do not decide if it was in self defense or anything else, they are the gateway to the legal system. He commited a crime and he had to be arrested.

I will bet that the police on scene didn't want to arrest the guy but they had too. In addition, I highly doubt the DA will follow through with any charges.
