Mine did the exact same thing even while being fired and after being sent back once. In my case it turned out to be a faulty magazine and once replaced with a new one has been 100% ever since.
Ruger never figured this out. I learned by accident when i tried a second one on my own.
I would definately try to find another magazine before you send it back also. Mine would fail to feed every few shots. A trip back to Ruger fixed nothing as they tested it with thier magazines not mine.

The mount is aluminum and bends quite easily. I have one on a .223 and thought I broke it because it bent so much. It does seem to hold quite well though.
