    Open carry picnic in Oregon

Peacefully picnicking in a park is not seeking confrontation. I bet they'd be perfectly content enjoying their event and not have discourse with anyone. That someone else may confront them, police or antis, when no crime is being committed, is no reason not to exercise their 1st Amendment...

The 9th Circuit will address this issue before Chicago even gets out of the starting gate. A (very pro 2nd Amendment apparently) three judge panel will review California's Nordyke v King (07-15763) case soon. link

DOES HELLER RECOGNIZE A RIGHT TO CARRY ARMS!? - article

I think the USSC will find like the Ohio SC did: CC laws stand (even WI and IL bans) because OC is constitutionally protected, and your hypothetical cc conviction will stand sadly. Ironicaly, both the Ohio defendent's and Emerson's convictions were upheld even though we generally support the...

DOES HELLER RECOGNIZE A RIGHT TO CARRY ARMS!? - article

JM, I grant that your cause is shall issue CCW. And I support that too as a right (Vermont style). But I still don't see how you can say Open Carry, the basic right alluded to in Heller and recogninzed in state court holdings, could be banned if CCW is "shall issue" (albeit taxed and...

Next step post-Heller: the 14A Incorporation issue. Details :)

The AG can form an opinion, which can influence or give cover to agencies who use that opinion in determining GC. And if an AG said self defense consistant with 2nd A. purposes was GC, a CA court, although not bound by an AG opinion, will give it the respect and weight entitled to the state's...

Next step post-Heller: the 14A Incorporation issue. Details :)

I don't see SCOTUS doing a Post Heller "OC or CC" decision where the state chooses the method of carry. I see the court finding Loaded OC as the 2nd A protected right (I wish it was Vermont style) and then allowing a WI. or IL. ban on CC. I just can't see a patchwork of "state choice"...

To Carry Or Not To Carry...OC/Mace

OC spray I would carry a small can. However, I've found O/C to be less effective than desired. Don't put yourself at risk thinking O/C will work unless a better "stop the threat" option (firearm) can be instantly deployed. Having O/C on your person when your gun is deployed/fired can help...
