Are standard capacity magazine bans vulnerable to be challenged under the "common use" model? Since the most common weapons of our time use 15, 20, and 30 round mags, aren't they protected under Heller and not subject to being banned?

I'm sure some in congress feel a little more latitude to pass this, knowing that time is running out on the Senate actually doing anything with it before the end of their term. If God, forbid, McCain is unsuccessful, the whole thing may be a moot point when Congress re-convenes.
