1.) What is the difference between a machine gun and a sub-machine gun? Is there a difference in the laws surrounding them? (It's late, I'm groggy, so random thoughts are occurring.)

2.) When the ATF comes for inspection of a C&R holder, what happens if you don't have one of your items at the premesis (i.e. you hold the license jointly with your wife, she is present for the inspection, you are delayed on a business trip with a East German Makarov in your posession, which is in your books, but obviously not in the collection)?

Let me chime in with an educated guess before someone who really knows something comes along. :D

My guess concerning #1 is that they have to do with size. A machine gun would be like an M-60, nato caliber. A submachine gun would be a Mac10, 45 caliber, IIRC. The same laws would apply.

Concerning #2, my guess is that from time to time you've got to remove certain pieces from your collection for purposes of trade, etc. But to be sure, the rules are doubtless outlined in the booklet for C&R holders.
 
A submachine gun uses pistol caliber cartridges, such as 9mm or .45ACP. A "machine gun" uses rifle caliber cartridges, like 7.62x51 or .30-'06 or even .50BMG. An "assault rifle", as originally defined, slots between a subgun and a machine gun, because an assault rifle fires an "intermediate" cartridge such as 7.92 kurz (the original assault rifle cartridge), 7.62x39 or 5.56x45.

Submachine guns and machine guns are both regulated exactly the same in the U.S. They are considered "machineguns" under the National Firearms Act. For ordinary citizens to own them, they must have been properly registered prior to the effective date of FOPA in 1986, you have to pass the background check and get CLEO signoff, and they are subject to the $200 transfer tax.
 
ATFE will call to schedule an inspection. A C&R holder may also elect to have the inspection done off site, at his/her discretion.

Only thing I know without a doubt about sub guns, or machine guns, is I will never be able to afford one!
 
I don't think you can hold a C&R jointly with your wife. It isn't a business FFL so there is no need to have more than one person on it. I could be wrong though. Check with the ATF.
