The deer see it just as poorly. I've had them walk up to 15 feet, having birds land on my gun barrel was enough to prove to my son that motion not color is what gives the game away.
It's the law in Arkansas for deer, elk and bear modern gun and muzzleloader season. I'd wear it anyway even if it wasn't.
You also can wear chartreuse but I prefer orange.
I go both ways, as here in NH, it's not required. Depends on my mood and where I'll be going/sitting and the day of the week and season.
Opening weekend and I'm going down the trail and up onto the "easy" ridges on public land? Better believe I'll look like a Halloween pumpkin!
Wednesday morning on week 2 or 3? Maybe, maybe not. Depends on how cold it is and what isn't standing and walking by itself!
Of course, I've never shot a deer, but I've had a few walk up on me. Some when I was wearing orange, and I don't think they knew I was there until I turned my head to check out that "big squirrel in the brush" that turned out to be a pair of does.
Its required in Wyoming for antelope, deer and elk. I use the camo pattern orange which is also legal. Too many trigger happy hunters. I'd wear it anyways.
