But if someone has taken your firearm that you've entrusted to another party, could that firearm not be reported as "stolen"?

That's probably not the best way to go about this--I tend to also think that once the red tape monster is figured out, the firearm will make its way home.

I'd love to hear the final resolution on this.
 
If this is a bankruptcy, neither local LEO's nor the BATF have squat to do with it. You need to apply to the trustee's office and you should be able to get your property back quickly. It is not a fixture of any real property and would not be subject to any UCC lien. Nor was it an "asset" of the shop. It just happened to be there when the place closed down.
 
I'm with Cosmo: your gun is not their asset; any money you owed to the shop for work performed is an asset. In similar fashion, if your car had been parked in a lot that they owned, could they have sold it to pay off creditors? Of course not. The difference is only that it's possibly easier to tell that the car is yours.

I think that the UCC that Mark mentioned calls the situation a "bailment." They have physical possession, but not ownership, of your personal property -- like your shirts at a dry cleaner.

I hope it's that simple; first you have to find it. I suppose that the Trustee can help you with that.
