Hornady TAP ammo in IL

Apperently I just won a box of Hornady Tactical Action Police on Gunbroker. The seller is asking for a letter proving I am legal to own this ammo. Does anyone know of any restrictions for Illinois?
 
Chicago / Cook County has restrictions on ammunition.

You need an FOID card.

From Hornaday's website:

"These loads feature clean burning propellants and enhanced terminal performance, with rapid expansion and bullet fragmentation. Yet these highly effective bullets will penetrate soft body armor making them an excellent choice for patrol rifle programs and SWAT teams."

(As far as I'm aware, pretty much ALL 223/5.56 NATO loads will smoke through soft body armor, so whatever..)

Since 223 can be used in various pistols, you run the risk of violating Unlawful Use of Weapons - whether or not you have a pistol chambered in that caliber. (Illinois armor piercing definition is specific for "handgun" bullets only, but does not specify anything further. Due to T/C pistols being chambered in every conceivable caliber, there is a high likelihood of a prosecutor being able to construe that everything you have IS a handgun caliber!)

There's probably a lot of case law out there.

What I do know is there is nothing specifically in Illinois law that prohibits armor piercing (AP) rifle ammunition, it only qualifies, specifically, handgun ammunition (and the criteria is in the law I linked above - jacket composition, etc).

While there's nothing specifically illegal about you buying AP Rifle ammunition, I would advise caution to you that since the "rifle/handgun" line is blurred on all calibers, and particularly so on 223/556, since there are a wide variety of purpose built 223 PISTOLS in circulation.

Anyway, not a lawyer and don't know case law, so what you do is up to you.
 
I believe a copy of your FOID card to the seller will suffice, but I am not sure as I have never dealt with gunbroker. However I have ordered ammunition before and once they had my card on file all was well.
 
Thanks, very informative. I Am far from Chicago (thank God), and definitly don't have a 223 pistol. I finially got ahold of a friend in law enforcement, and he assured me it was legal for me to own, but was unclear about a "statement of intent/legality". I have an ex- state police friend that I intend to call for more clarification. If I learn anything of value, I will post it later.

I've never been bashful about buying / owning AP rifle ammo in IL.

I am cautious about what I keep on hand because in 5.7x28mm I have both the handgun (FiveSeven) and the rifle (PS90). I keep the 5.56 55 grain AP pulls I have completely separate (stored elsewhere) just to avoid any potential problems. No pressing need to make AP for 223 (seems kind of stupid, given how they work, IMO) - holding on to the surplus stuff just because it's pretty much non-available since Talon went the way of the dodo, and prices go up with time...

Then again, I don't load or plan on using 223 for home defense, so I'm content with FMJ plinkers. If it's your first pick for home defense, by all means, get the best ammo you can feed the thing. :)

Given the massive varieties of ammunition / projectile types for 223, I do pose one question though; why choose the TAP ammo over something, like say a 62 grain V-MAX? Those are some volatile little buggers.
 
Believe it or not it was an accident. I bid on it late one night, forgot I even did it. Was about to file a claim with gunbroker when I got the "you won" email. Then I remembered I bid exactly the opening bid, $120 for 200 rnds, no more. I find it easier to bid than to click "watch auction" Never dreamed I'd win. Also, I have a 1 in 9 barrel, so I've been looking for medium-heavy bullits. These are 60's. Hope they shoot good. Should make a mess out of a coyote.
 
Just got an email that the ammo is on it's way. I think that the seller was just performing a CYA manuver.
 
Yes, but according to the law, wouldn't something like Lake city steel penetrator in a handgun be illegal? You can get it anywhere, but if you load the ammo into a pistol you could be charged?

Yeah, that's the general consensus - if it's loaded in to a pistol, it's illegal (in some jurisdictions; the state of IL being one of them.)

I always wondered how this applied to stuff like Carbon 15 and other .223 pistols though. Mine blew up on me years ago, and all I have in .223 / 5.56 is rifles now, so I don't mind keeping AP on hand in that caliber.

Usually, constructive possession is enough to get you at least arrested & charged (with all crimes, in general, not just firearms). Then it's left up to the states attorney to decide if it's worth prosecuting, then arraignment, and later a judge & jury to convict.

Personally, I don't want to even get to the "arrest" part of that chain.
