Bradley introduces bill to protect gun owner's rights
By Diane Wilkins, Marion Daily Republican
MARION -- Illinois 117th District State Rep. John Bradley's telephone has been ringing nonstop. And callers are asking about a bill he introduced to protect a gun owner's right to defend property against intruders.
"I have been on the phone all day with Chicago and upstate newspapers, TV and radio," said Bradley in a Wednesday interview.
The Marion Democrat introduced the legislation allowing for an affirmative defense to a violation of a municipal ordinance that prohibits, regulates or restricts the private ownership of firearms, if an individual is charged with a violation while using their firearm in self-defense.
"Law-abiding and responsible citizens should be allowed to defend their home and protect their family without fearing that they themselves will end up in jail," Bradley said.
Bradley said that he had been asked by the gun owners' association to sponsor the legislation.
Recently, a Wilmette man was arrested and charged with violating a city ordinance that banned handguns after defending his home against a burglar who had broken into his residence two times in less than 24 hours. The intruder was shot in the shoulder and calf before driving away in the homeowner's stolen vehicle. Under current law, the homeowner could serve a year in jail for violating the handgun ban.
"The latest events in Wilmette underscore the importance of providing a defense in court for those persons who protect their family and property against criminals," Bradley said. "This bill will put some rational thought back into the law and protect the rights of average citizens to defend their home."
Bradley indicated that most of the feedback he was receiving had been favorable.
"This law is common sense, and I hope my colleagues will agree that citizens have the right to defend their livelihood against those that violate the law," Bradley said.
Bradley, a member of the National Rifle Association, is hopeful that House Bill 4075 will gain the support of his fellow legislators.
