Indiana: 15 day NFA signature signed into law


"Indiana: Governor Pence Signs Pro-Gun Bill"


NFA sign off's, in Indiana (CLEO signature for NFA items) must be signed within 15 days by the CLEO (Chief Law Enforcement Officer) if the applicant is not prohibited by law from receiving it. The law goes in effect July 1 2016. Neighboring state, Kentucky also has had the 15 day NFA sign off rule in place already.

New Federal NFA legislation going in effect July 13 eliminates the need for the CLEO to sign off of NFA items.

"Yesterday, March 21, Governor Mike Pence (R) signed House Bill 1085 into law. HB 1085 requires a chief law enforcement officer (CLEO) to sign an application for the transfer of any item regulated under the National Firearms Act (NFA) within 15 days if the applicant is not prohibited by law from receiving it. By removing any possibility of personal bias and creating a statewide standard, HB 1085 protects the rights of law-abiding gun owners across The Hoosier State. HB 1085 passed the House of Representatives with an 87-8 vote and the Senate with a 45-5 vote.

The timing of this seems a little odd considering the sign-off requirement goes away in July. So basically this bill is only relevant for the next three and a half months. Don't get me wrong, I'm not against this bill, but it doesn't seem to make a lot of sense to pass it now. Maybe these bills were originally written before we all knew the exact requirements of 41P? But even then, they obviously kept going well after 41P became 41F and we all knew the sign-off was going away.
 
Yeah, that would have been a good law to pass like 10+ years ago. It's a waste of time now.

Nope, it will only really be relevant during the 12 days between when it goes into effect, and when 41F goes into effect. Probably not worth the couple hours of legislative salaries it took to pass. I assume they did it to appease the 2A crowd without actually having to step out on any limbs.

Thanks, I missed the part about it not going unto effect until July 1st. That's even more ridiculous.

So the law requires CLEOs to sign off within 15 days, but the sign off goes away 12 days after the bill goes into effect. What a waste of time and taxpayer's money.
 
41P, (Now 41F) is a rule, not a law passed by congress. The next president (or this one) and his/her administrative bureaucrats can change the rules again, thereby requiring CLEO signoffs. Not relevant now, but who knows about the future?

Take victories when you can & encourage your lawmakers to do more.
 
Cant the state still require that the CLEO sign off on "something". Doesnt necessarily have to be the form 4.
 
I agree with the above. It might be sort of moot since 41F takes effect in July. However, every pro-gun victory, however small or even late it might be, is a good thing. I've been hearing about a lot of pro-gun victories lately from open carry to states and municipalities taking away the power of local officials to deny people guns and what not. Largely, at the state level, things are going ok. At the national level, we are plagued by a Democratic White House. Fortunately, the Congress and Senate keeps those nitwits at bay. Losing the presidency to Billary will be terrible enough. We cannot afford to lose the Congress and Senate. No matter how excellent our state and local governments are, there is no telling what or how the politicians at the federal level will try to destroy the 2A and undo any state/local progress.

Agree.

Even with 41F, it's still better to have a "Shall Sign" law on the books and not need it than otherwise. That way, if - for whatever reason - BATFE decides to "revisit" the change effective 7/13/16, you still have protection at the local level from discriminatory/anti-NFA biased CLEOs.
