Apples to oranges, yet again. Police in this country do not deal with IED's and suicide bombers on a daily basis, if they did I suspect you would see the same thing happening.

So, based on the definition you provided, if the Marine in question believed that the terrorist was only pretending that he was injured beyond the capacity to fight or believed that the individual was attempting to employ a weapon or explosive device, the terrorist in question would not be a detained person.

The other group's beliefs are irrelevant. Here is why:

Marines fought their way into the mosque on Friday. Sites said 10 militants had been killed and five wounded prisoners were left behind as the marines moved south.

The next day, there were reports that mosques in the area had been reoccupied, including the one with the five prisoners.

There was no way the Marine involved could have known whether the terrorist lying on the floor was part of the group of wounded from the day prior or a more recent occupant of the mosque. In fact, we do not know if the Marine was aware that five wounded enemy personnel had been left in the mosque the day prior.

A parting thought. Using some unit's powerpoint presentation, especially when a Staff Sergeant is listed as the primary instructor, is a poor way to support your arguement.

If the Marine is not convicted of murder or if it never goes to trial, you take out an advertisement (the smallest size will do) in the Marine Corps equivalent of the Army Times (Marine Times?), acknowledging the Marine did no wrong, thanking him for his service and apologizing for the unkind remarks you have been making about his character. Signed by you, not a psuedonym.

If the Marine is found guilty of murder, I will pay you whatever the cost of such an advertisement is.

Anything charge other than murder, all bets are off. No quibbling.
