An 87-year-old man shot a woman in self-defense after she tried to rob him, police said.

Angela Smalley, 27, was in serious condition Wednesday afternoon at Erie County Medical Center after undergoing surgery for a gunshot wound to the abdomen. Smalley jumped into Willie Malone's car while he was parked in a shopping plaza at about 3:45 p.m. and demanded money, police said. Smalley told him to drive her to a street but he refused, according to officers. A police spokesman did not know whether she had a weapon.

Malone instead drove to his neighborhood and parked near his home. In search of money, Smalley starting reaching into Malone's pockets and grabbed a .38 caliber handgun he had holstered on his belt, officers reported.

The two started a struggle that spilled out of the car and Malone recovered his gun, firing one shot.

Police said Malone has a valid gun permit. He will not be charged, but will be brought before a grand jury.

Her weapon was a 60 year advantage over Malone.

Bet she wet herself when she discovered the gun, and I hope he's faster getting it into play next time....

So the police aren't going to charge him, but they are going to seek a grand jury charge? I must be missing something here. :barf:
 
The Buffalo DA probably doesn't have the authority to clear shootings in that venue, so they all have to be taken to a GJ, is my guess.
 
Elderly Man Tells Police He Shot Woman Who Tried to Rob Him

(Buffalo, NY, February 12, 2003) - - Buffalo residents are defending their elderly neighbor who shot a woman who tried to rob him.

Police say 27-year old Angela Smalley tried to rob 88-year old Willie Malone outside his home on Brooklyn Avenue Tuesday night.

Investigators say Malone had a gun and it went off during the struggle. The bullet hit Smalley in the chest.

Neighbor Lanisha Malone said, "I know he's a sweet old man. He's very overprotective about his property as you can tell. He did what he had to do."

Smalley is listed in serious condition at ECMC.

Police have not filed any charges against Malone at this time. They say he had a valid permit for his gun.

Elderly Buffalo Man Grateful He Was Prepared When Woman Tried to Rob Him

(Buffalo, NY, February 12, 2003) - - An elderly Buffalo man says he's grateful he was prepared when a woman half his age reportedly tried to rob him Tuesday. The would-be robber ended up with a gunshot wound to the stomach. Senior Correspondent Rich Newberg spoke with Willie Malone about his harrowing ordeal.

88 year old Willie Malone buys the paper every day at the Rite Aid at Jefferson and East Utica. On Tuesday he had company.

A woman entered his car uninvited and demanded a ride to the Broadway Market. Willie drove home instead and then, he said, things got nasty when she demanded money.

Assault victim Willie Malone said, "She reached and got the keys while I couldn't move. I had a coat on, big pockets. She just put her hands in the pocket."

Willie, who bought a gun 31 years ago to protect his barber shop on Clinton Street, had the .38 with him in a hip holster. The woman, he said noticed the gun.

Malone said, "Then she tried to take it and me and her scuffled and one got to it, the other got on to it and she tried to get it...and it went off. I don't know who had pulled the trigger."

27 year old Angela Smalley was rushed to ECMC with a bullet wound in her stomach. The shock was almost too much for Willie's wife Catherine.

Mrs. Malone took it harder than her husband. She has a weak heart. She needed oxygen after the incident and was taken to the hospital. Now she's praying for the woman's recovery.

Catherine Malone said, "I'm just sorry it happened. I didn't want nobody to get hurt and I just pray that she got better...and that she learn her lesson right there!"

As for Willie, he hopes Angela Smalley doesn't die. But he's not sorry he protected himself.

Willie said, "I prepares myself for what could happen when I go out. I'm always thinking. They got different ways to get you, so you got to be ready if you ain't ready, shame on you!"

Willie Malone had two hip replacements. He worked as a barber until he was 84 years old.

Angela Smalley is in serious condition Wednesday at ECMC.

At 87, what difference will it make if a grand jury indicts him, he won't be around that much longer anyway. Way to go daddyo!
