I am going to sell one of my firearms. I know if going across State lines, you must ship to an FFL; however, as I understand it having been on the ATF website, I can ship *direct* to a resident of my own State (FL) so long as I have no cause to believe the person purchasing is not a criminal.

I was wondering if anyone had experience with this - and wanted to make sure I am right. Id post up a link to the ATF rule, but on my phone here so can't, but thats what it looks like to me. And if I am right, does anyone know if there are additional hassles with UPS or Fedex shipping direct to a resident.

Thanks

For Rifles: There is nothing to call the ATF about. Its legal on the federal level so you just have to worry about state laws. In my state (NC) it is legal, I have done several on both ends via USPS and UPS. UPS has a stated policy against it posted in our branch, but I've never had a problem. From the information you have available to you, the person needs to be able to own said gun. You usually collect a faxed/scanned copy of driver's license to insure that the person is a resident of your state and over 18.

Hmmm. This looks more like a "Legal" Question than a "General" Question.;)

Anyway, in one state that I lived in it is legal to send a rifle/shotgun, but I'm not sure about a handgun. Just make sure that you verify that the person is able to own said weapon and check your state's laws. (I ought to look up my CURRENT state also:D)

tj you are right it is legal...typing on my tiny phone keyboard is a pain, if a friendly mod could move it, id appreciate it!

It's quite legal to ship any firearm to another state resident, provided that you have no reason to think they're a restricted person and your state/local laws don't prohibit it.

This includes handguns - you just have to ship them via a common carrier (not the Post Office).
