A little good news here. Not completely unexpected but I'll take good news where I can find it these days.


WASHINGTON -(Dow Jones)- New York City on Monday failed before the U.S. Supreme Court to revive a lawsuit it filed against the gun industry.

New York sued several gun manufacturers in 2000, arguing the companies violated a state public nuisance law with their marketing and distribution of the firearms products they sell. Among the companies sued were Beretta USA Corp., Smith & Wesson Holding Corp. (SWHC), Colt's Manufacturing Co. LLC, Sturm, Ruger & Co. (RGR) and Glock GmbH.

beautiful. I doubt they did, but I do wish the SUPCT's opinion would include a detailed explanation of how this is BATFE's job anyway (that they haven't done all that well).
 
BATF&E had nothing to do with this case.

WASHINGTON - The Supreme Court has turned away pleas by New York City and gun violence victims to hold the firearms industry responsible for selling guns that could end up in illegal markets.

The justices' decision Monday ends lawsuits first filed in 2000. Federal appeals courts in New York and Washington threw out the complaints after Congress passed a law in 2005 giving the gun industry broad immunity against such lawsuits.

The city's lawsuit asked for no monetary damages. It had sought a court order for gun makers to more closely monitor those dealers who frequently sell guns later used to commit crimes.

But the 2nd U.S. Circuit Court of Appeals ruled that federal law provides the gun industry with broad immunity from lawsuits brought by crime victims and violence-plagued cities. The Supreme Court refused to reconsider that decision.

The lawsuit was first brought in June 2000 while Rudy Giuliani was New York mayor. It was delayed due to the Sept. 11, 2001 terrorist attacks on the World Trade Center and because of similar litigation in the state courts.

The city refiled the lawsuit in January 2004, saying manufacturers let handguns reach illegal markets at gun shows in which non-licensed people can sell to other private citizens; through private sales in which background checks are not required; by oversupplying markets where gun regulations are lax, and by having poor overall security.

The city said a state nuisance law makes it a crime to knowingly or recklessly create a condition endangering the safety or health of a considerable number of people. But the appeals court said New York's law does not qualify as an exception to federal law. It agreed with U.S. District Judge Jack B. Weinstein that the Protection of Lawful Commerce in Arms Act, signed by President George W. Bush in 2005, is constitutional.

The cases are City of New York v. Beretta, 08-530, and Lawson v. Beretta, 08-545.

Giuliani by the way is an excellent example of a RINO (Republican In Name Only).
 
This wasn't even on my radar. I just heard on the radio that the supreme court rejected allowing lawsuits against firearms manufacturers for the misuse of their products.

Good news, but I didn't even know they were considering it.

People (working for Bloombug) ? (yes bug) traveled about attempting to make straw purchases.
The VA Attorney Generals office told them to stop. It seems the VA govt is not fond of people attempting to make illegal purchases, no matter how above the law they are.
If I recall VA said they would have to file charges if it continued.
 
I wonder why they didn't file charges when it DID happen. Perhaps the shills sent out by Bloomberg were illegal aliens? Hmmm?

Bloomberg is a dangerous man. He's got AWB obsession to the max.
It's nearly a singular issue with him. I believe the guy has been
promoted as the latest trial balloon face in the renewed assault on the 2A.
 
What a whiny ***** Bloomberg is. His *** is covered w/ a NYPD security detail 24/7, and he wants to tell not just NYC, but the entire country what they should/shouldn't own. He's the type of guy who would wipe his *** w/ the constitution if he wasn't using two ply $100 bills.

I once read a deposition given by the city’s clueless leader. Bloomburg is a control freak. Over and over he would make the point that “HE WAS THE MAYOR,” and therefore every decision had to be made, or at least confirmed by him. On the other hand he didn’t have the slightest idea what make and model of pistol was carried by officers in his own police department.

There is nothing wrong with New York City’s firearm laws. The whole crime problem is because the rest of the country doesn’t follow they’re example. :barf:

He will do everything in his power to bring that about. Operating beyond the city limits doesn’t bother him at all. Stepping on a BATF&E investigation in progress is of no concern. Stomping on small gun dealers with the overwhelming financial and legal resources the city can bring to bear is fine.

What’s good for New York City is good for the U.S.A. Just ask him… :banghead:
