Don't jump to conclusions so fast. I also bought a S&W Sigma .40. So far, no problem with the gun. Personally, I like it a lot. Completely accurate. I'd say give it a try and see if you like it. I would think you would take a beating on it if you were to trade it in -used or not. IMHO.
I'd like to add my condolences as well. It's times like this that snaps us back to reality as to what is really important in life. You are in my prayers.
My advice: Communication! Bought my first pistol from Gunbroker.com and communication was key. I was new to the process and had no prior buying ratings. After all was said and done, both buyer (me) and seller thanked each other for keeping the other informed.
