Is it legal to have gun in trunk and drive around?

According to the Gun Free School Zones Act, it's a federal crime to have a gun with you unless it's unloaded and in a locked "container or firearms rack" when you are within 1000 feet of a school. It's not possible to drive many places without passing some sort of school (day care center...

    Federal Gun Free Zone Question

Another point worth noting. If you have a CCW issued by your state, you'll still violate the federal law if you drive by a school with a long gun that's not in a locked case, The law requires you to have a license to carry the gun in question, and no state that I know of issues licenses to carry...

    Civil liability in justified shootings

Quote: If you are served with a civil action in a matter like this and you ignore it, the plaintiff just asks for a default judgement and the fact that you are supposedly immune doesn't come into play. BAM!! judgement for the plaintiff!! A "default judgment" for WHAT? Ohio law SPECIFICALLY bars...

    C&R legal question

What makes a "straw purchase" illegal is lying on the Form 4473 (the part that asks if you are the real purchaser). Since there is no Form 4473 for C & R purchases, a C & R purchase couldn't possibly be a straw purchase (in the legal sense). This doesn't necessarily mean that it's OK for...

    Civil Suits in Florida

In most criminal cases it is the state that must convince a jury beyond a reasonable doubt that the defendant did something illegal. So in that kind of case, an acquittal does not bar a subsequent civil suit. If Florida has a different rule, where is the law that says so? Certainly not 776.032...

    Civil Suits in Florida

It's true that the law provides that you will be neither criminally nor civilly liable if your shooting was justified. But, as gatorjames85 said, it doesn't follow from this that being acquitted in a criminal case necessarily means that you will win a civil case. In each case, the issue is...

    Inheriting guns from dad

Glad it worked out. This thread is also a nice reminder that not all lawyers are going to charge you a bundle for simple paperwork. There are times when a few bucks for good legal advice is a wise investment.

    Shipping a rifle to yourself?

Well, probably. But four years doesn't look all that temporary. I was never worried about his leaving them here, since we were then residents of the same state, just about my giving them back. That was certainly a transfer of possession. I'm pretty sure ownership doesn't have to change for a...

    Shipping a rifle to yourself?

(quoting NavyLT How clear is this? I was faced with this situation a couple of years ago: My son, then a resident of the same state as I am, went into the army, got sent overseas, and left his guns here. He said I could use one of them while he was gone, and I did. Four years later he got out...

    Inheriting guns from dad

What you propose is the way most non-rich people handle inheritances. I'm not knowledgeable about Illinois inheritance laws, so I can't give you an authoritative opinion. But I suppose I can say that I don't know of any reason why what you propose would violate any law or make you something...

    Inheriting guns from dad

I am sometimes amazed at the willingness of people to post answers even though they have no idea what they are talking about. 1. If you can qualify as an heir of the guns (unclear on these facts, but probably you can), the executor, who will be appointed by the court, can transfer them to you...

Interstate trip posessing guns that you don't own?

True. Also if you become a resident but then move out before 60 days. Or if you dispose of all your guns before 60 days. Or if you never had any guns to start with. Numerous possibilities here, none of which changes the rule that was being discussed.

Interstate trip posessing guns that you don't own?

Of course. So you have to register your guns within 60 days of establishing residency. That seems plain, but somebody said it was wrong, gave no reason, and has clammed up. As pointed out earlier, you normally become a resident immediately on moving in if you intend to stay there.

Interstate trip posessing guns that you don't own?

It seems to me that the rule saying you have 60 days until registration is required is just another way of saying you have 60 days to register. In other words, up to 60 days without registering and you're OK: registration isn't required yet. Go past 60 days and if you haven't registered you're...

Include your SS # on the NICs application?

For about $20, any crook who wants it can get your Social Security number. It's best to assume that anyone can get it and plan your life on that assumption.
