It is illegal int eh state of Florida to compile a roster of gun owners. Says so right in statute 790. Gun shops are allowed to comply with federal regs requiring back ground checks and such but aren't supposed to keep the names of the purchaser for more than thirty days.

If Wal-mart is video taping and keeping a list that certainly sounds like a violation of Florida law to me.

No, I don't have a specific article about some fight between Wally World and the state of Florida. It hasn't happened yet. Although, I do spend a lot of time around a lot of pro-gun politicians in this state. It could happen soon...:D

What got this topic going is that my wife, 173 IQ and a compulsive reader, is studying the 790 in preparation for applying for her permit. She read the law concerning creating a list or registry of gun owners in Florida and wondered out load how Wal-mart was going to do this here.

If any lawyers out there who are familiar with Florida law want to chime in I'd be interested in what you have to say.
 
I am not a lawyer, but this is my guess.

Not really sure, but i know wal-mart's policy is to comply with the state laws where that particular wal-mart store is located.

I dont see how wal-mart could possibly trump state law. I think they will either comply with state laws, or will simply stop selling guns in that state if they feel strongly enough about their new experiment.

Unless the government comes up with new laws or regs., then i dont see any way wal-mart could do that in Florida. :confused:
 
Wal-Mart will more than likely continue to do this until the state tells them to stop.

That translates into Wal-Mart is going to due what ever it wants until someone with a lot of money and time decided to match legal wits with one of the biggest corporations on the planet.
 
Walmart will win. Come on. When will America learn that you cannot defeat money.

Can Walmart simply state that they are just making a customer database, then put it with their Sams Club listing, making it yet another customer data base?

Video taping? Oh, thats simply for security purposes. :( :( :(
 
IANAL, but I believe the prohibition on a registry only applies to the state and local governments.

PROHIBITIONS.--No state governmental agency or local government, special district, or other political subdivision or official, agent, or employee of such state or other governmental entity or any other person, public or private, shall knowingly and willfully keep or cause to be kept any list, record, or registry of privately owned firearms or any list, record, or registry of the owners of those firearms.

If walmart is challanged they'll most likely just stop selling guns in FL stores like they've already done in other locations.
 
^ Yep, it will be an easy choice for them. They don't sell guns in any that I have been to in the last year. Not even in the valley where there are a lot of gun owners.
 
I am working at a walmart in FL while I go to school. If you don't believe the firearms log book that has your name phone number and complete address and also exactly what gun and caliber with SN isn't a registry. They keep this book for 20 years "in case your gun is stolen".

This is true. I worked for Wally World from 2004 to 2005 and sometimes ran the register at Sporting Goods to cover someone's lunch.
 
If it comes down to it, they'll pull guns from the stores and not look back. Every Walmart in my area stopped selling guns a while ago.

The one I go to for late night diaper and formula runs still sells ammo, but not after 10 o'clock. Heck, they wouldn't open the knife display for me after 10. They probably thought I was going to stab people while wearing diapers and drinking out of baby bottles.
 
I know they keep bound books. Whats to keep the government from seizing these bound books with everyones info in it?
