    DC Carry ruling... finally

In the above post re: SC GFSZ's that does look bad for a permit holder. But it is still a State law violation, not the Federal law, as far as a SC permit holder is concerned. I'd take the State rap over the Federal one any day. If caught, I would argue that it says "into" a "place", and if...

    DC Carry ruling... finally

In the above quoted GFSZA text, remember that it requires that you knowingly violate. Signs would be needed to make you aware you are in many of these zones.

    DC Carry ruling... finally

In Heller, I seem to remember a sentence that used the words "at the ready" or "in case of confrontation" or something like that, so that implies a loaded gun, not an unloaded gun. So that would be an absurd outcome to be able to continue a ammo ban. It will be interesting if they appeal, that...

Abramski v U.S. Supreme Court Decision (Straw Purchase case)

I read the facts of the case. This is a case of falsification on a government form. Don't do that. The moral of the story is that you do not (should not) collect money from someone for the purposes of purchasing a firearm for them. This guys downfall is the record that was created my making a...

This description sounds like they are asserting the raised cross on the clips is not to be copied by anyone.

Interesting question about Il carry and hotels in Chicago

Possibly you have screwed up that first sentence? You always need the license in your possession when carrying a concealed handgun. When not carrying a concealed handgun, the license is not required, and 24-2 exemptions, among a couple of others, apply.

Interesting question about Il carry and hotels in Chicago

Over on another forum site, an example scenario was given as to what a judge/jury would do to decide if what you are worried about was actually what the law means. I am adapting this to the subject at discussion here. Mrs. FOID Jones and Mr. FCCL Jones are entering the same Hotel. The Hotel...

Interesting question about Il carry and hotels in Chicago

Do you have a FCCL? please read the back of it. This is where the endless loop starts about gotcha laws in IL. Where there are 2 laws, one says the penalty is x and the other says the penalty is y, you are entitled to the penalty that is the lesser. This is the basis of why the IL AUUW law...

Interesting question about Il carry and hotels in Chicago

The Firearm Concealed Carry Act allows persons with a Firearm Concealed Carry License to carry a loaded or unloaded, concealed handgun when not on their own property. Someone from out of state isn't going to be able to do that as of now, if ever. Those people will need to transport their...

Illinois res. & airazona gun laws

Is this clause a limitation or restriction? It doesn't say they may ONLY purchase from a surrounding state. It says they may. "May" is a permissive term. It is certainly different than "may not" or "shall not".

    United's Firearm policy

It's really not a big deal with any of the airlines. If I had to guess based on what I have seen over the years as an airline passenger, there is at least one checked firearm in the cargo hold of every airliner in the air, on average. The last flight I took, there were 3 of us checking guns...

Is there a statutory construction problem with 18 USC 922(d)? Selling to a felon?

Don't sell to anyone whom you have any reason to suspect is a prohibited person. Why would someone say something like that to a seller unless they were trying to trap the seller?

EP Armory 80% poly lower update

They obviously have an internal document or documents they are using to make determinations. They are regulating. They should be forced to disclose, that way it's there for all to see. Is there something they are afraid to let us see? Or is it just sloppy, arbitrary and capricious the way they...

EP Armory 80% poly lower update

I say that sunshine is the best disinfectant. Let's cut the guessing games. Any other regulatory agency publishes a NPRM and follows the administrative procedures act along with several other regulatory acts; they define specifically what they are trying to regulate; how they are trying to...

EP Armory 80% poly lower update

Which brings us back to the a&c argument. They should have to publish the guidelines instead of having to play cat and mouse. The "clarification" letter we are now discussing is proof of the guessing games.

EP Armory 80% poly lower update

Yes, they are being kind enough to spell out the areas they deem as having gone too far. The only solution at this point is for EP to make the thing homogenous, eliminate the nubs that locate the holes and start supplying a jig made out of the same material to keep the cost down. This could be...

EP Armory 80% poly lower update

The totality of these actions by BATFE is that they believe the whole "80%" lower thing, combined with the 3D printing coming online; the whole unserialized thing is about to go mainstream, they are trying to quash it before it gets too prevalent. I recently saw an article about someone making...

EP Armory 80% poly lower update

Actually, it is obvious from the dates on the letters to and from EP and BATFE that they did not wait for a determination. The letter from EP is from July 2013 and the BATFE letter that says "it's a firearm" is dated February 2014. What is not so obvious is there was likely some off record...
