Right now the estimates as to when something is going to happen is May 2015. Lets say the ruling goes into effect on May 30th, 2015. Would that mean all applications from that date forward would have to comply with the ruling, or could they say that all applications that are in the ATF's possession and not yet reviewed have to be in compliance as well.

Just thinking out loud. Never know what hoops they are going to make us jump thru next
 
Im just speculating because nobody knows for sure how this will all be finalized but my guess is that if you can get the form 4 in and the check cashed you will be fine. I doubt they will refund all those checks.

But even better is if you can get it in, with the check cashed and it can go pending which as far as i understand means its in the stack at the examiners desk waiting for approval. That takes probably anothert month or two after the check gets cashed.

This is totally a guess though. I'm putting in one last form 4 here in probably the next couple weeks on an 870 SBS. Waiting on the form 3 to get started currently.

So in May they are going to announce whether or not it will be implemented or not correct?
Just because the majority of feedback is against these changes doesn't necessarily mean they'll it alone right?
 
What are our *chances* (SP) of them not making the changes? Or is there no precedent and all just pure speculation?

While I will never pretend to understand how the process works, I've had a form 1 pending since 11/21/14 and as of last week still no examiner assigned.
 
So how would e-forms work if they required fingerprinting/passport photo/ CLEO sign off for trusts? Couldn't e-file any more right?

Correct, which would make the money they've spent on eForms already and are spending to fix eForm 4 be wasted. But when has the current administration ever given a hoot about wasting taxpayer money?
 
That would suck. Stranger things have happened though (how you hold your property in your hands determining whether you're evading taxes or not).
 
The technical reason for not going to eForms for everyone is that you can't submit photographs, fingerprints or CLEO signoff electronically.

But other than that, I agree that e-submission is the way of the future.

And I've also got my fingers crossed that eForms will put a stop to 41P. But I know that the right hand might not care what the left hand is doing.

Any way they were talking like it would be up and running again the first quarter of 2015, but the ruling on 41p is due out in the second quarter. So they stall the e-file system go with the current ruling and use e-file only for Form 3 dealer transfers.

Once again we get screwed

Form 1 E-file is still alive and well. Only form 4 E-file is down.
 
Just received an eFiled Form 1 today (January 30) that was filed December 20. Man, if only Form 4 could move this fast! I'm still waiting to fill out the paperwork on a purchase that was paid for before Thanksgiving. The Form 3 transfer to the dealer hasn't cleared yet.

Really hoping I can start the process and get in under the wire just in case 41p actually happens.
 
As others have said, eForms is not down. It is being used by lots of folks with trusts for Form 1 right now.

The current projection is that the Form 4 will be back online by end of 2015. That's new info from the ATF's NFA Branch eForms people, released this month. They are working with a new vendor and involving industry partners to make the system work right this time. (And the sarcasm comparing it to other government computing systems is getting a bit tired. There are no reason for them to know that SilencerShop was going to try to batch process tons of transfers, which is what the system couldn't handle.)

The head of the NFA Branch knows about 41P. He also knows exactly how much money is being spent to revamp eForms, including getting industry partners involved. I cannot reconcile those things in my mind unless one of two things is true: 1) the regulations aren't going to be enacted, or 2) they are going to find a way to make eForms work with CLEO signoff, photographs and fingerprints.

So, I'm hopeful about 41P, personally.

Thanks for the note of optimism, Aaron. Here's hoping you're right.

Paper forms seem to be doing better. I had one that took the better part of the year (ugh), but another that was just over three months (not bad, considering). eForms for F4 would make things a heckuva lot more handy. I'm tempted to F1 a couple via said, but that is off-topic. ;)
