This is a drive-by posting. Folks should understand clearly that what was remanded was the lower (district) court's decision not to grant injunctive relief. Although it is human nature (augmented by video talking heads) to treat this as a preview of the final outcome based upon encouraging language in the 2-1 opinion, we are a long way from the conclusion of this litigation.
