I know I can only buy a handgun from someone in KY, and even a gun sold by an out-of-state FFL must be transferred to an in-state FFL. I also know I can buy a long gun from an FFL in any state and take possession, more restrictive state laws notwithstanding. Here’s my question: can I buy an NFA item like a silencer or SBR from an out-of-state FFL and take possession directly from them once approved, or must it transfer on a Form 3 to an in-state dealer?

As far as I know, NFA is Dealer to Dealer across state lines. You then collect from your in-state dealer.

Yep. And if it was previously transferred F4, you're looking at a $400 double stamp, double wait process for interstate transactions. That's why there's virtually no secondary market for NFA outside of MGs (and some DDs), where the cost of the stamps and the wait for something you can't build or buy new are just part of the deal.

Now, if it was a dealer/manufacturer owned NFA item, then it transfers tax free on F3 to your local SOT (usually a few days to a couple weeks), and then just a normal F4 process from there.

But within the same state there could be right? You can buy a suppressor from an individual with just a $200 stamp if they're in the same state as you i.e. no dealer required.

I'll defer to @dogtown tom for general regulations elsewhere, but here in CO, an FFL still has to conduct any transfer outside of immediate family with a 4473 in accordance with state law. But yes, intrastate NFA transfers betwixt individuals are single F4, single tax per item.

OK ... here in MT we don't need to use an FFL for such transfers ... yet.
