CA Gun Question

Hey all,

A quick question from here in the People's Republic of California. I know that I am limited to one new handgun purchase per 30 days from my local gun shop.

My question is, does that apply to out-of-state purchases as well (e.g. if I buy a gun on gunsamerica.com and have it shipped to my FFL)? Or, can I buy as many of those as I want (he says hopefully)?

Actually, I believe it is a case of 'new from a dealer' vs. 'private party facilitated by a dealer'.

Private party sales are not restricted to one a month, although the sale must go through an FFL.

You still have the waiting period (10 days).
 
Out of state PP sale/purchase

Even though you are buying from an individual, if that individual is out of state you must transact through a FFL and you will be held to the 30 day rule. PPT (relieving you of the 30 day rule), only applies to "in state" trades or sales and both parties must be present at the FFL to consumate the deal.

the only reason I know this is through a personal experience that took place two months ago when I traded pistols with a guy in Virginia. Me and the DOJ went a few rounds over the issue, but you who wins those bouts......

You can go to a Firearms Store and buy more than 1 consignment handgun in a 30 day span.

For example, go to Turners and they will sell you 2 or 3 consignment handguns at the same time.
 
That's very true. But in a consignment sale you are actually buying from the individual and not the dealer. I brought this issue up with the the DOJ and they really could not explain why it worked one way but not the other? Makes no sense to me. But then it makes no sense to me that a CCW holder that has jumped through some really hot flaming hoops, must still go through a 10 day waiting period in Ca.
 
Yup,

We can buy as many consignment pistols as we want without going thru the 30 days, or we can do as many PPT's we want without the 30 days.

Now, since the consignment is buying from the individual, why do we get taxed when we buy a consignment gun?

If my memory hasn't totally failed, when you buy an automobile from a private party in CA, don't you have to pay sales tax on the purchase price when you register the car? Legally, it's the same thing with any private sale/purchase...you either pay a sales tax or you are supposed to declare the purchase on your state income tax and pay a comparable use tax.

When I was there (three months ago), anytime you buy from a dealer it's one gun per month, regardless. That's whether it's in state or out of state.

The only way around this, IIRC, was if you buy consignment guns. I bought more than one gun in a 30 day period because I bought from individuals.

I don't know if a certain Turners you have been to allows this or if you have done this yourself or are maybe just assuming it but the Turners I've been to count any used or consignment pistol they have sold me as counting as one a month. Has caused and is causing many a headache for me.

You are right, but it is actually called a "USE TAX". Symantics, ya know......
