California bill to remove guns by family request

I did not find a thread on this topic.

Without knowing the exact details of what is contained in this bill it strikes me as tremendous potential for abuse along with being illegal.

"A bill allowing family members to ask a judge to order firearms removed from people likely to commit gun violence was sent to California Governor Jerry Brown on Friday for signing into law.

The bill... creates a so-called gun violence restraining order in the court system. Under it, immediate family members and law enforcement agencies could petition a judge to order guns temporarily removed from certain individuals.

The restraining order would last 21 days, and could extend it up to a year, after a notice and a hearing
."

Essentially it appears that based a mere accusation a gun owner will have all of his firearms taken from him forcing him to defend his right to own firearms without a criminal conviction, domestic violence charge or adjudication of being mentally ill.

Woe be wary of spiteful wife or family members.

While I am not a California resident there is always the chance other states will pass similar laws. Anyone have any more information about this law?

This was passed because of a mass stabbing, if you can fathom that logic. I personally don't see how this WON'T be abused, considering all of the other ways restraining orders and the court system in general are abused here in CA.

First, this is not a helpful way to start a discussion of a new law. The exact details matter a great deal, and discuss what one thinks the law is based on a news article, without having the actual law, is a huge waste of time and energy.

Second, the bill is not law. It's been passed by the Legislature and has gone to the governor.

If/when it's been signed and has become law, and when we have the actual law in front of us, will be the time to discuss it.
