Nordyke Oral Arguments

(CALGUNS.NET) - Redwood City, CA. 3:03PM 12-14-2008.

The Calguns Foundation would like to invite you to the Oral Arguments in the Nordyke case. Nodryke is the case that will make the landmark DC v Heller case apply to California. This means an individual right to firearm ownership.

It is quite important for the actual Nordyke appeal that we pack the courtroom and the overflow. Our counsel would like to be able point out the large number of "The People" sitting in the courtroom that day who believe that this is an individual right that applies to California. Background on this case and why it is important here.

CGF will be hosting an event afterwords. If you can also attend that, please post that in this thread.

To remind, the argument is Thursday January 15, 2009. The argument will start at 1:30 PM in Courtroom 1, 3rd floor of the James R. Browning US Courthouse.

The address of the Court is:
United States Court of Appeals - 9th Circuit
95 Seventh Street
San Francisco, California 94103

This is at the corner of Mission and 7th and is one block from Civic Center BART. There are a couple of parking decks closer to the Convention Center that are easy walks.

You must have government issued photo ID to get in the building. Note that no weapons, or knives of any kind are allowed inside the Courthouse building. Photography is also not permitted. I'm making sure the court can seat a few hundred "The People" for this case. Please wear business attire - we want to look impressive. I'll be in a suit and tie.

A large showing of well dressed firearms owners will help prove the point that the Second Amendment matters.
Edited to add: Please cross post this to other forums, blogs, etc. A very large turnout is very important.

100+ Calguns members attended in the courtroom and overflow.

Opinion expected in about 3 months, so mid-April.

General run of opinion is positive for Our Side, but counsel for Nordyke reminds us that high expectations have been disappointed before. OTOH, the small number of supporters for Alameda County left pretty quickly; a reporter couldn't find anyone on that side to talk to.

We, however, were on the steps taking pictures....

So is this the case for Incorporation?

Yes. As I understand it, oral argument went pretty well. The highlight being when the attorney for the county tried to assert that a gun show could be conducted without guns actually being present. This claim elicited laughter from the gallery.

The 3 judge panel hearing the case has been shown in the past to be favorable to 2nd amendment rights.

Our side was represented by Don Kilmer, who filed an amicus brief in the Parker case at the Court of Appeals level (that case became Heller in front of SCOTUS). Also of counsel for our side was Don Kates.

The case also has a lot of other issues involved which may derail a ruling on incorporation... Specifically, one of the issues is state law preemption of local gun control issues.

.
So does even if we win this one for Incorporation it would still need to go to the US Supreme Court before it made Incorporation applicable to all to states.

Basically yes. A ruling by the Ninth Circuit is law only in the Ninth Circuit -- Washington, Oregon, California, Idaho, Nevada, Arizona, and Montana.
