Can an executive order be used to ban importation of surplus ammo?

Been already asked and answered in context of ammunition, CCW etc etc etc.

In a nutshell he cannot generate a "new law" banning importation of ammunition but can direct any federal agency in it's interpretation of an existing law.

For example, he could issue an EO "clarifying" the "sporting usage" for importing firearms extends to "assault" non sporting ammunition such as 7.62x39.

The EO could be challenged but best of luck.......
 
And its not just the 'sporting language' we have to contend with. There are certain countries (China, for example) from which arms and ammo cannot be imported from due to other trade regulations, executive agreements, treaties, and embargos (most of which must admittedly go through congress and/or the senate). Note that you can import all the TV's and consumer electronics you want from China, and you can import all the 762x39 you want from Russia (for now), but you cannot import Chinese 762x39.

If tensions with countries such as Russia continue to stay high, I'd expect a push for a Chinese style arms & ammo embargo from an Obama administration.
 
The executive branch has broad discretion in matters of foreign policy - import controls are only one part of that. For example, Bush 41 banned import of elephant ivory via executive order, in a manner that if someone on vacation had a legal ivory pendant and left the country with it, they would not be able to legally return with it.

So an imported ammo ban would be easy. :mad:
 
I suspect unless Russia sobers up quick on < 50 a barrel oil revenue versus the >150 a barrel revenue that has made them feeling their oats and more assertive ammo imports from them will halt with the next 'incident' or failure to communicate. Might even got serious enough to include vodka too.
