Okay, so here's what I'm thinking -

There are some laws that I think are ripe to picking apart and taking down with the right plaintiff, right facts, and standing. For instance, the arbitrary distinction between rifle and pistol, short barreled rifles and shotguns, 922, suppressors, etc. To anyone that honestly evaluates these, these distinctions of pistol vs. rifle, stock or no stock, once a rifle always a rifle, etc., size, length, etc. is arbitrary at best and at worst counter-intuitive. For instance, why would one make it illegal to put a stock or forward grip on a pistol for increased control??? Why not encourage suppressors on guns to dampen noise pollution? Makes no sense...

But we all know the arguments... I digress.

I think now is a great time for this move though, on the heels of two huge victories with McDonald and Heller and momentum!

So my wheels are turning on how to legally take our rights back and erase these laws off the books.

Need the Perfect Plaintiff. I submit ... ME! :D Model US Citizen of average background. Licensed attorney. US Army highly decorated combat veteran with multiple deployments to Iraq. Gun collector. NRA lifetime member. Never been arrested for anything in my life (knock on wood!).

Need standing to sue. I think that simply attempting to legally purchase something, say a short barreled rifle or a supressor and being denied without a tax stamp would provide standing to sue.

Need $ to hire the best lawyer for a swing for the fences. NRA maybe? Maybe join in a class action suit with many other similarly situationed perfect plaintiffs?

I am not aware of any ethical issues against this move. Any lawyers out there issue spot this one?

Does anyone have any suggestions? Thoughts?

I would be willing to bet that anyone (Including myself) that has a replacement stock on an SKS would be more than happy to get involved in a class action suit, I agree that 922r is a stupid law, I mean, outside of promoting american made goods, it serves absolutly no purpose that I can think of.

Also I think that owners of TC contenders and encore pistols have a gripe as well,(I would join that fight too).

The other one I think could be attacked is the interstate purchase of firearms. Say, for example, I am a resident of Tennessee and am in Montana on vacation. I brought one pistol with me for self defense and can legally carry. Say I lose the pistol or am robbed of it or it breaks at the range, or I'm getting it gunsmithed, etc. Now I am faced with being unarmed until I make my way all the way back to Tennessee because I cannot buy one in Montana. That may be the makings of a great lawsuit. Be denied a purchase of a gun in a very gun friendly out-of-state place like Montana, Texas, etc. Then sue the Federal and State governments.
