Delayed, then denied by NICS

If you know you've got gun rights, despite what the NCIS thinks (after all, you would know for certain one way or another if you've got a felony or other legitimate disqualifying factor, regardless of what NCIS's out of date database says) then can you just buy a gun from a private individual? Would you be breaking any laws by doing so?

I would think not! Once, several years ago I was delayed at the point of purchase, I then went to another gun store within an hours time and was instantly approved for purchase of a handgun.
When I returned to the other store I was still under delay the next day...

I've purchased ten long guns and five handguns in the past 14 months. My pistol permits here in NC went right thru, but when buying long guns about half the time I get delayed via NICS. I called them once and spoke to a lady for ten minutes. Essentially they will not tell you anything at all and they were quite rude, as well. I have a misdemeanor from 15 years ago but I'd just gotten five pistol permits. Not a problem. Couldn't understand it. On the five or six times I got a delay they always called back within 24 hours with the go-ahead and I never had to wait the four days, but it was still very frustrating. I have since found out that because I have a General discharge from the US Army about half the people manning the phones will see it and go "Oh ... well .. he isn't supposed to be owning firearms. We better look into this." Then someone tells them "No, only a Dishonorable discharge prohibits ownership." With 10 rifles and shotguns in one year you'd think they'd be educated by now.

More than likely, your appeal will have a positive outcome and you'll find out it was some idiot who didn't understand the rules.

Gotta love the Federal government and it's job-for-life admin cronies.
