NEW YORK — Two out of state gun dealers sued by Mayor Michael Bloomberg for allegedly selling firearms illegally have agreed to a settlement that puts their sales and inventory under the microscope of a special monitor, city officials said Monday.

The two shops in Georgia were among approximately 45 out-of-state dealers targeted in a sting operation this spring because officials say they have supplied hundreds of weapons used in New York City crimes over the years.

The Bloomberg administration sent private investigators wearing hidden cameras to attempt "straw purchases," where one person fills out the legal forms and makes the purchase for another. The ruse is illegal and often used by convicted felons and others who cannot own firearms.

The majority of dealers refused the sale, but the 15 that allegedly allowed it were named in the federal lawsuit filed in May. Two shops — which had allegedly sold firearms linked to assaults, shootings, narcotics offenses and at least one killing in New York City — agreed to a settlement, with terms that include a special master closely eyeing their practices.

According to the settlement, the two dealers — A-1 Jewelry and Pawn and AAA Gun & Pawn Brokers — will be supervised for three years, but the clock will restart if there are any violations. For its part in the agreement, the city dropped its pursuit of monetary damages as well as its attempt to halt sales. They must also pay the city penalties if they allow illegal purchases.

The dealers did not immediately return calls seeking comment.

Bloomberg has made gun control a top priority for his second term. His administration's unusual sting operation outside state lines appears to sidestep the law signed by President George W. Bush last year that gives gun makers and dealers protection from civil suits, except in cases where they violate the law.

City officials said they hope the other 13 dealers named in the suit will join the first two and agree to be monitored.

Former U.S. Rep. Bob Barr recently filed a $400 million (euro313.3 million) lawsuit against Bloomberg, claiming the sting operation that led to the suit was "careless, willful and clearly illegal" and that a dealer was defamed in the process.

Bloomberg has dismissed Barr's suit as a "publicity stunt."

Sounds much like a consent decree - I never did it and I promise never to do it again.

For my money it's admitting that Bloomburg was right.

I hope the other dealers stick it out and expose the straw purchase sting for what it was - an unlawful act.

Good the pawnshop owner settled. Now what will Bloomberg do when he is hit with conspiracy and straw purchase charges by the ATF? (i'm waiting.... *crickets chirping*) Why did the store owner settle any way? What jurisdiction do NEW YORK courts have in Georgia where the 'crime' was committed? Shouldn't it be the Georgia state courts or the federal courts in charge of the prosecution?

The store owners should have told bloomingidiot to take a long walk off a short pier. Not only does he break federal law, he blatantly deprives them of their 6th amendment right to:

That yankee garbage should be facing federal charges under the 1968 gun control act and also facing charges for Deprivation of Civil Rights Under the Color of Law.

Just when exactly can we start shooting these SOBs? It's obvious the government is not going to police their own. Hell William Jefferson is going to skate and they caught him red handed with $100,000 stashed in his freezer and on tape taking bribes.

How, exactly, does a dealer recognize and refuse a straw purchase?

I mean, if the guy walks in and says "I need a gun for my buddy, a felon," that'd be one thing, but I'm guessing that doesn't happen a lot. If the guy passes his background check, pays, leaves, and then hands the gun off later... how would the dealer ever know?
 
Then again,

don't underestimate dealer venality. There are clear straw sales where the "true buyer" is right there with the straw purchaser, picks out the gun, fondles it, then turns to the buyer and says, "That's the one I want." All in front of the clerk. If we don't clean up our own house, the Bloombergs of the world are more than ready to do it for us. And rub it in our faces.

In 2001 the incumbent mayor, Rudy Giuliani, was prevented by term limits from running for re-election. Several well-known New York City politicians aspired to succeed him. Bloomberg, a lifelong member of the Democratic Party, decided to run for mayor as a member of the Republican Party, reportedly to avoid the crowded field in the Democratic primary.
 
Having gone to American Society for Criminology meetings for a few years, it's know that a small number of shops are responsible for a very disproportionate number of new guns used in crime. They measure Time to Crime. They usually sell cheap guns with multiple items to one person. Then they show up on the streets of nongun friendly urban cities pretty quickly.

The ATF has been slow to deal with these places. Unfortunately, there is some validity to the straw man claims as easily seen when you check their books. It is a small slice that tars the rest of the merchants.
 
I'm guessing the purchasers slipped in a quick mention that it was for a friend, as far from straightforward as possible, and some sellers didn't catch it.
Ah but that in itself isn't illegal if it is a gift and a private transfer doesn't require a background check. Only illegal if you are buying it for someone who by law couldn't do it on their own or with someone elses money.

in NY you wait a year for a permit to buy a gun then wait 90 days to pick it up.
1 year 3 months! If you complain about the wait, they make you wait longer.

It's little wonder poor people figure out ways to get their guns.
Everything is illegal in NY so if your caught sitting on your own
milk crate in front of your own store (yup, blooming idiot made that illegal) with a .25acp in your pocket you're facing years (for your gun crime)

If you shoot a crazed killer who just killed your wife and is slitting your childs throat, with the gun grandpa gave you before you moved to NYC and you didn't register it ( a daunting gauntlet of byzantine bureacratic bovine excrement that takes years ) you are going to do at least a year on Rikers Island (for your gun crime)
....not everyone arrested in NY for "gun crime" has done anything unconstitutional, it's just that NY politicians and criminal justice system show a depraved indifferemce to the Bill Of Rights

I'm pretty sure that is intentional. Why make the existing laws work when you can allow the level of crime to increase as justification for more extreme laws later?

Of course, I could just be paranoid.
