I am just curious if anyone has bought from Jack Black on Gunbroker. He seems to have the best prices for AR uppers.
HE states that the barrels are Wilson arms.....which i have never heard of and the upper receivers are made by the same company as Bushmaster.
Is he selling junk or a decent setup?

Without a permanently attached flash hider, is this considered a short barreled rifle?

:what: A 14.5" barrel with a removable flash hider is a Short Barreled Rifle and is regulated under that National Firearms Act. The flash hider must be permanently attached (pinned and welded) for this to not be NFA.

Mr. Jack apparently doesn't know this (he is stating in the auction that it is legal as-is), and is setting his customer up for big, big trouble.

He can sell the uppers with any barrel he wants. An upper is not a rifle. If you put it on a lower then thats your problem, not his. Hell im in CA and can but short barreled uppers....

...cant do anything with them though.

Yes, it is legal for him to sell, but it is NOT legal for Joe Blow to buy this for $335, slap it on a lower, and simply go on his merry way. To legally assemble this as a rifle you must either:

1. File a Form 1, pay $200 tax, and register it as a SBR.

2. Pin and weld the flash hider.

Well, he should advise bidders that assembling the rifle in this configuration would be illegal.

As for him as a seller, he has 1570 transactions with an A+ rating. Must be doing something right.

He does mention the fact that the flash hider can be permanently attached if desired, he just doesn't sell it that way.

It's the buyers job to remain legal, you can't possibly put every kind of disclaimer known to man in an ad, nor should you be expected to.

well i am considering buying this upper

I am thinking about buying this upper for a project. Since i live in communist New Jersey i will have to ground off the bayonet lug and Hard solder a phantom muzzle break on it. I was then considering trying to Duracoat it in some type of camo. I think it would make for a fun project. The price seems right.
My real question was what do you guys think of the quality of this upper he is offering?
Thanks for all the responses. I try to always questions on this board before i jump into something.

If a person already has a lower in their possession, then as soon as they get this upper, they are in vioatin unless they have obained the proper paperwork, correct? This would be the same as me buying a full auto sear kit. If I don't have a lower, then no big deal, but if I have a lower, but no paperwork, then I am in big trouble, whether I install it or not. Am I correct on this? I might like this upper as well, but I would like clarity. If what I stated above is correct, then I would have to pick it up from my FFL, and take it immediately to a gunsmith to have the flash hider pinned and welded before ever bringing it home. Is that right?

Is that right?

Technically, yes. Welcome to the goofy, insane world of gun control laws. If you have the parts, then it is de-facto manufacture, whether it is actually assembled or not. Now, if you have a NFA registered lower already, then you are OK.

I have a similar question. If I have a complete lower and a stripped upper (no barrel) in my possesion and purchase a short barrel without assembling anything, am I breaking the law?

Would it be safe to assume that any device,(flash hider, suppresor, fake silencer, muzzel brake) permanently attached to a barrel
under 16 inches, with said attachment makes overall length 16 inches or longer Legal?

If so, what if you had a repairable suppressor that could be taken appart for cleaning and such?

Not really but if you get caught with all of it a cop can still bust you for intent on building a SBR.

Thats what ive been told, i could be wrong.

when the suppressor is appart is the barrel under 16inch and still able to fire. If so then yes, it would illegal.

You are also talking about a registered suppressor right?

Purchased some parts from him (not an AR upper though), and it turned out fine. No problems at all.

He is a con artist, stay far away... dont believe me? check out his feedback on gunbroker.com :cuss:

I think...

that you are a little misinformed... notice how he had an perfect A+ rating for years, selling to thousands and thousands of customers, then suddenly fell off of the Earth?

...seems as if he got raided by the US Attorney's General Office via the local police department, and I have heard rumors of FBI and BATFE involvement as well.

The local paper had a small article about it on the 5th, I believe the raid (search warrant service) took place during the evening hours of the 4th. The paper failed to mention any charges, only that boxes of gun parts were being hauled out by authorities.

I know he sold quite a few lowers, and he didnt have an FFL, but Im not sure as how thats a crime... people sell guns on gunbroker everyday without an FFL. IF they were his personal property, then I suppose he was jumping through the loophole.. of course we all know how PRO GUN our current government is... they'd never attempt a case on something so thin, right?!?! :barf:

Im not entirely sure of why the raid too place, I noticed that he sold alot of full auto fire control groups, but again, Im not sure if thats actually illegal or not... all of those areas are kind of gray. One minute, you CAN own and possess them, the next minute (i.e. someone gets a burr up their rear) they call it 'intent to manufacturer' and kick in your door. ...kind of like saying having beer in your fridge and a car in your driveway is having intent to drive drunk.

So does anyone know any specifics?
