Which would draw the response of the chief, "I'm sorry but the camera malfunctioned. No tape exists."
The victim's attorney has already seen it and a [ludicrous] offer to drop the charges in exchange for an agreement not to sue the cops and the city made by the prosecutor.

"The camera malfunctioned. No tape exists... although we previously showed it to you." is going to be a VERY hard sell in Federal civil court, never mind an Ohio criminal court. The city might as well put up a sign the size of the "Hollywood" sign saying, "We're a pack of liars and NOTHING we say under oath can be trusted!"

That would almost certainly be a loser and open the city up to even further liability.

If Chicago didn't think they could get away with it in the Weems and Abbate cases, I doubt that some town in Ohio would have the stones.

Last year(?) there was a segment on NPR's "Talk of the Nation" about citizens recording police. In Maryland, EIGHT dashcams ALL failed SIMULTANEOUSLY. The female reporter who sued got a judgment or settlement that was in AT LEAST six figures.

Nobody thinks he's more clever than the lowest grade moron thinks he is.

Not being able to produce the tape from a dash cam in this kind of instance is more incriminating than anything that could be on the tape. A department would throw an officer under a bus before they would open themselves to that kind of liability.

While not a dash cam, I've had camera footage save me from litigation before. The claims were so far beyond what actually occurred to they dropped it altogether...the complainant thought things had occurred which never did or he just made it up to make it sound better. It is the exaggeration that sinks many claims of excessive force.
 
I hope the guy gets 'em where it hurts the most... their wallet. Sadly, financial loss is the only thing most organizations care about. I hope he sues the crap out of them.
 
  1. Do you think you will need a firearm to defend yourself LESS when your wife is there? Did the doctor in Connecticut?
  2. If you have the proper license, your handgun is "legal"... at least in 49 out of 50 states.
Don't let some low IQ bully force you to be a victim of a violent crime from which he has no duty... or ability to protect you.

No bully ever STOPPED being a bully because he got what he wanted by BEING a bully. Bullies always escalate when they get their way.

I am capable of defending me and mine, had enough practice working midnights for many years on 14th St., NW &R, 14th & Park Rd. in DC where a firearm is illegal and an old hillbilly like me didn't care for DC jail, long story. Let's just say I don't worry much, I still work at an offensive defense I have practiced for years, anything to win. I have trained over 10yrs with a walking stick/cane, have honed awareness over the years and I do know how to hurt people. Not many "bad" guys know how to read people and always underestimate. I carry where legal but I have never used a firearm or knife on anyone in the USA. I can avoid most situations and those that I can't, well I have handled before. I choose to avoid the hassle in Ohio. My call, my choice
 
I think this is all speculation uintil the tape comes out.

Until then, we're looking at a (fairly reliable) second-hand report on another forum ... we don't know how accurate it is (either direction) and we don't have a news story or even a police blotter entry to reference.

But it IS a reminder to figure out how your phone's record function works and be ready to use it and release it widely in cases like this.
