Ok, Someone told me that shipping long guns, you don't need to send to FFL as long as it's in the same state (Tx). Now, in terms of shipping, can I just put it in a box, unmarked ? Also do I have to go with air mail or ground shipping is ok ?

Also is it within law for me to have the comitted buyer fax me his TX DL ?

I am pretty positive you can not use the US Mail. A shipping company will ask you to declare the contents of the package from my experience. You can be vague and claim "mechanical parts" or something like that. That may or may not work depending on the clerk. Different companies have different policies and those change over time, I'd suggest coordinating it with them up front. They may even want to seal the box?

Declaring it a firearm makes it less likely it will reach the destination in my opinion. If it doesn't reach its destination the purchaser is going to think you ripped him off, you'd probably want to insure it.

I've only shipped a few firearms and those went back to the manufacturer they have FFL). Went smooth once, ran into hassles with a clerk the other time. I've no idea what methods they chose to transport them.

Face to face (FTF) is the only way I'll do private transactions and I think a lot of other people are the same way according to the want ads I've read.

1. USPS is OK to use for long guns, and would be my method of choice. Yes, just a plain unmarked box is what you want. There is no requirement in Federal statutes to inform them what is in the box. I can't find it in postal regulations either where you have to inform them.

2. I think that ground shipment is OK with UPS and FEDEX for long guns. I think it is only handguns that THEY require to go next day air. Again, there is no requirement in Federal law to inform them of what is in the box, but, with UPS and FEDEX, it is their company policy that you are supposed to inform them.

3. I know there is a local Texas shipping company that does firearms very well, but I can't remember their name.

There is nothing against the law about asking him to fax his TX driver's license, but I personally would have a problem with that if it wasn't specified as a condition of sale right up front.

Not only that, but there is actually a part of the Brady Bill that says they cannot require you to label your box as having a gun.
"No common or contract carrier shall require or cause any label, tag, or other written notice to be placed on the outside of any package, luggage, or other container that such package, luggage, or other container contains a firearm."

There are not federal regulations for in state shipping of long guns but you should always check state/local laws. Its OK in most states. If your doing it UPS or FEDex just put the name of the gun in description (Colt AR-15, etc), the counter person does not look at it and you have done everything correct for insurance purposes, etc. USPS takes them also, but generally UPS Ground is cheapest method of shipment. If you want in an tell the counter person you have a gun, you have a 50/50 chance of getting someone that does not know there company's regulations and you are in for a hassle. You should typically require a photocopy of a DL to make sure they are of legal age.
