Jim Coburn Calls Override of Lynch Veto

Concord, NH – In a press conference held this morning at the Legislative Office Building in Concord, Jim Coburn called on his legislative colleagues for an override of Governor Lynch’s veto of SB 318 a measure that would have ensured a citizen’s right to self defense outside of the home. “This is a bill that would have kept honest citizens from fearing prosecution for having to use deadly force in self defense. Governor Lynch has chosen to put outrageous fears over the rights of New Hampshire residents.” Coburn stated. At the time of the veto, Governor Lynch commented that he has “…seen no evidence of any case in New Hampshire where someone was unjustly prosecuted for defending themselves or their loved ones.” Coburn responded saying, “According to Governor Lynch, we should wait until someone suffers the horrible experience of being tried for murder before we act. I feel we should be progressive in making sure our laws protect our citizen’s right to defend themselves and their children, a right that would now be protected under SB 318 as passed by majorities of the House and Senate.” Coburn urges his legislative colleagues to take up overturning Governor Lynch’s veto as soon as they return to session.

And at least THIS one became law, to prevent a post-Katrina situation. SB 348 has made it a Class B Felony to take firearms as they did there.
The new law, a paragraph added to RSA 4:46 pertaining to the taking of private property during a state of emergency, is as follows:

I-a. Under no circumstances shall this section be construed to authorize the taking, confiscation, or seizure of firearms, ammunition, or ammunition components.

This will go into effect in 60 days, on July 14.

RSA 4:46 has a penalty provision of a Class B felony in paragraph VI:

VI. Any person who willfully takes possession of, or attempts to take possession of, property, purporting to act under this section but without authority to so act, whether by false pretense or otherwise, upon conviction, shall be guilty of a class B felony if a natural person, or guilty of a felony if any other person, and 1/2 of any fine imposed shall be paid to the owner of the property and 1/2 to the county.

I'm just sorry that Lynch is apparently somewhat popular amongst the (unflattering term for MA transplants to NH who brought their culture along). Gubernatorial elections are this year and Jim Coburn is running for the other side.
 
As far as I'm concerned, if my life is threatened I will respond with lethal force if the situation warrants it, no matter where I am.
 
I think that while the laws are already strongly in favor of self-defense, any disambiguation is always welcome. The burden of proof should always be on the state, and better that charges were never filed in the first place.
