Conceal-and-carry law challenged on constitutional grounds

State legislators acted unconstitutionally when they passed a 2003 gun-permit law by adding it to a bill about natural resources, foes of the gun law argued in court Thursday.

Minnesota House members who sponsored the law, which makes most law-abiding citizens eligible for a permit to carry a handgun, amended it into the natural resources bill to smooth its passage by the Senate, gun-law opponents said.

In doing so, however, the gun law's supporters violated a Minnesota Constitution provision that says no law shall embrace more than one subject, attorney David Lillehaug said.

He urged Ramsey County District Judge John Finley to strike down the gun law, saying legislators "must not cut corners."

Assistant Attorney General Richard Varco Jr. argued that the Minnesota Supreme Court has applied a broader rule than urged by the gun-law opponents in interpreting the single-subject clause of the state Constitution.

Finley took the case under advisement without ruling.

Groups supporting Lillehaug's argument included 33 religious organizations, several social-service groups and the city of Minneapolis.

Most of the religious groups also argued that the law unconstitutionally infringes on their property rights.

The gun law is unconstitutional because it takes away the groups' ability "to keep gun-toting people out of our parking lots" and out of properties rented by the groups, attorney John Gordon said.

Varco argued that the gun-permit law does not violate church groups' property rights , but merely states "how ... people already allowed on your land [are] to be treated."

Unity Church of St. Paul and White Bear Unitarian Universalist Church, which filed the original lawsuit, and several other religious groups also argued that the law violates their right to free exercise of religion.

Their attorney, Marshall Tanick, argued that the law "conflicts with their beliefs and ... missions."

Varco argued that the law does not violate religion rights because it does not discriminate against the religious groups because of their beliefs.

A judge in Hennepin County ruled in March that church groups who filed an earlier suit there challenging the gun law can temporarily ban guns in their parking areas and on rental properties.

The law infringed on the groups' right to free exercise of religion by asking them to tolerate actions that conflict with their religious beliefs, Judge Marilyn Brown Rosenbaum said.

Good pickup Matt, but with the Strib it's almost too easy. Along the same lines, I saw the front page headline Thursday on all the legal trouble Pat Forcia (a local democratic bigwig) is in. Goodie, I thought, it will be fun to see how far down in the story they bury the fact that he's a democratic mover and shaker (DFL, here). Um, they never mentioned it, although they did say he worked for Wellstone. At the risk of stating the obvious, had he been a republican it would have been mentioned repeatedly, beginning with the first sentence.

To keep it more gun related, the Strib's recent article about the anniversary of the passage of the "shall carry" law quoted the two most anti-gun sheriffs in the state, the ones from Washington and Scott counties. There are, I think, 87 counties in the state; wonder why they sought out these two for a reaction? Actually, I don't wonder.
 
Maybe if the churches keep sticking their noses into State and Federal affairs, they should lose their tax break privileges that they have....They should just stick to God's work and leave Minnesota's affairs to elected officials and voters..................
 
They spend 4 years in Urinalism School learning how to turn every story in a polished piece of propaganda. It takes technique and practice to become a "reporter" at a major newspaper. Turning a positive story into a negative one without outright lying is a high art.
 
I think it's just KILLIN' these people that there is not blood in the streets after the first year. If they can't object to the law because there's no evidence of danger, they'll think of something else to whine about. :neener:
 
There is a silver lining: If these whiners succeed and set a precident (sp?) we should be able to use it to keep Feinswine from tacking her new AW ban onto some unrelated law. Just a thought to keep in mind. I guess it would only work if there is a federal law about unrelated issues.
 
I have found the Star and Sickle very useful in the past couple years. You see, about two-and-a-half years ago, just after buying my first house, I bought a Weimaraner pup. Shortly after buying the pup, the Red Star decided that I might buy a subscription if they gave me a two-week free trial... Well, it only took about three days and Superdawg knew how to "Get the paper!" (BTW- if you've never seen a 15lb pup drag a 10lb sunday paper to please its master- put it on the short list of things to do!) The other 11 days were pure reinforcement... You shoulda heard the awkward silence in the phone conversation:

"Mr Z.. (proceded to choke on my last name), have you enjoyed your trial subscription?"

"Yes"

"Would you like to purchase our (whoopdi-doo) subscription package?"

"Nope"

"Why not?"

"Well, I already taught my dog how to fetch the paper... and that's about all your paper is good for, so now they're just filling up my trash can."

Off-Topic, but tangent... and hopefully as funny for you as it was for me- or at least funnier than my wife found it.
 
Even the 'Commie' er, City Pages has become less leftist/socialist than the Red Star and Sickle! Pravda has more balancled reporting! I can't even read that waste of paper without the veins on my forehead popping out!:fire:

They quoted the Scott county sheriff as being anti-gun? Menden said from the get go "these are good people" that were applying for permits.
