NICS background check frustrations...

Feinstein tries to introduce an AWB literally every year. I don't remember any panic buying last year, or the year before that...

Last year, or the year before, Obama hadn't just said a few months before that HE wanted the ban re-instated if re-elected. Last year, or the year before, we hadn't seen a full scale attack by a good portion of the media, every night, telling America how horrible an AR/AK platform rifle and a "high capacity ammo clip" was, and why NOBODY should be allowed to own one.

You know, those rifles that shoot "better than 100 rounds a minute!"

And, for the record, Feinstein didn't try to introduce an AWB last year, or the year before. She said she'd do that at a later day and time, when she had a better chance at success.

But let's not allow the truth to get in the way of a perfectly good lie!

This is a NICS deal. I've been delayed on 99% of my purchases and usually have to wait the 3 day maximum. I applied for a UPIN months ago but the good ol govment is months behind in processing applications. I have a CCW, but it was issued before July 2010 so I can't get cleared on the spot. It sucks seeing your new firearm and not being able to take it home right away. :(

Two hours on hold with the FBI?:scrutiny:

I think they're feeding you a line. It is entirely possible that it took them two hours to get through, or that there was a period where they were on hold.....but highly unlikely that they listened to that wonderful wait music:barf: for two whole hours.
if you don't hold, when you call back you go to the back of the line. Yes, there are dealers on hold for hours.

Personally, I use the web based E-check. No busy signals or "on holds" there! :)

What does the issue date of your CCW have to do with anything .. unless it has expired. That a Kansas thing?

Yeah, it's a Kansas thing. The state legislation to allow a CCW to proceed on a delayed transaction was passed in July 2010 and I got my permit in July 2009. The gun stores always do "further review" and it never works. Pretty silly if you ask me.

While normally I don't have to go through the background check to buy a firearm (NC CCW laws for in state purchase). I was on my way to Tennessee to pick up a Hk MR556 when the shooting took place. In Tennessee I still have to be run through the system. Luckily they had the rifle put back for me. By the time I got there I had found out about the shooting. I walked in the store and could not believe it. The lines were insane. It took over an hour for my NICS check to go through..and they (NICS) flat out refused without my SS number. It would have been a delayed or denied deal. So I gave it to the lady on the phone, bout 5200 rounds of various caliber ammo and left with my rifle. I was going to get the ammo anyway, and it happened to be cheaper than anywhere else in the past 3 years or so. Moral of the story, the NICS and Tennessee need to accept a CCW from other states as a background check. I know it is Tennesssee laws, but the recognize my CCW permit to allow me to carry, just not buy...

Heard on the news tonight the wait has gone up to seven days.
Not unless Congress changed the law last night between "fiscal cliff" hearings, and got the President to sign it.

Brady Act Requirements

Mandated by the Brady Handgun Violence Prevention Act (Brady Act) of 1993, Public Law 103-159

If potentially prohibitive criteria exists and more information is required in order to make the determination, the NICS Examiner will advise the FFL to DELAY the firearm transaction and the FFL will receive the following instructions:

“. . .NTN ___ will be delayed while the NICS continues its research. If you do not receive a final response from us, the Brady Law does not prohibit the transfer of the firearm on day/date.”

The NICS Examiner will provide the FFL with the date of the third business day after the firearm check was initiated. Business days do not include the day the check was initiated, Saturdays, Sundays, and any day state offices in the state of purchase are closed. If the FFL has not received from the NICS a final determination after three business days have elapsed since the delay response, it is within the FFL’s discretion whether or not to transfer the firearm (if state law permits the transfer). If the FFL transfers the firearm, the FFL must mark “No resolution was provided within three business days” on line 21d of the ATF Form 4473. It is recommended the FFL record the date provided in the delay response on which the firearm may be lawfully transferred under federal law if a final determination of proceed or denied is not received from the NICS.

I posted this in another thread, but will repeat it here since it is pertinent.

I was routinely delayed while in the USAF. All the FFL could figure, since they receive no reason one way or the other, is that perhaps my security clearance at the time was the holdup since many of his other military customers were similarly held up.

FWIW, I purchased two weapons the evening of Sandy Hook. No delay whatsoever.

I took the time to get mine back in Oct (CCP) and have bought 2 handguns since and love not having to get a permit for them..

Hold? On Black Friday that wasn't even an option.....NICS would answer and prompt you to do a check and then you would get a recording to call back later.....no option to be on hold or wait. Last week a recording would tell you how many minutes before you could speak with a NICS customer service rep....my longest wait was seven minutes. I've done more than eighty NICS calls in the last two weeks and never got put on hold for more than those seven minutes.

This week, NICS has answered on the first ring as usual.

Didn't do any on Black Friday did you?;)

Saturday, Dec. 29, about 6:00PM Central time, went through is two or three minutes. Long gun.

longknife12 In Coilorado, you gotta do a CIB instacheck before you can go to a NICs...
backlog from them is 8-10 DAYS!

Colorado doesn't use the FBI NICS, but does background checks through CIB only.

Security clearances, military service, being a police officer or even if you are a CIA ninja....... has no effect on your FBI NICS check.

Its all about NAME/BIRTHDATE/PLACE OF BIRTH/HT/WT/GENDER/ETHNICITY/RACE.......have enough of those match a person in the database who is prohibited and you get a delay at best.

Yeah, count me in, but I rather be in this mess than not being able to acquire what I'm looking for at all, which seems to be everything right now.

Hell, this whole mess I've been just a smidg above drowning; ordered my Ruger BX-25s just before they went OOS, got my 10/22 Takedown right as the site crashed from all the influx, got delayed on the NICS but my dealer let me take the Takedown's barrel to have it threaded and got it in right before the gunsmith got swamped causing a hold on all new work. At least I can get some excitement out of all of this, I guess?
