NY Target Shooting for Non-us Citizen

I have a friend that wants to take his cousin target shooting. His cousin is not a US citizen and does not have a US driver's license.

Correct me if I'm wrong, but in New York State (I'm talking the lower counties and not NYC) you are not legally allow to hold a pistol or rent one to shoot at a range unless you have a State Issued Pistol license.

Would this apply to long guns as well for a non-citizen?
 
Ok. Reading the statute, I would say there is no way the cousin could possess or fire the weapon. Below is cited where he is prohibited. All of the exceptions are listed in 265.20, but I found no exception in there that would allow the cousin from shooting a gun at a range.


§ 265.01 Criminal possession of a weapon in the fourth degree.
A person is guilty of criminal possession of a weapon in the fourth
degree when:
(1) He possesses any firearm
, electronic dart gun, electronic stun
gun, gravity knife, switchblade knife, pilum ballistic knife, metal
knuckle knife, cane sword, billy, blackjack, bludgeon, metal knuckles,
chuka stick, sand bag, sandclub, wrist-brace type slingshot or
slungshot, shirken or "Kung Fu star"; or
(2) He possesses any dagger, dangerous knife, dirk, razor, stiletto,
imitation pistol, or any other dangerous or deadly instrument or weapon
with intent to use the same unlawfully against another; or
(3) He or she knowingly has in his or her possession a rifle, shotgun
or firearm in or upon a building or grounds, used for educational
purposes, of any school, college or university, except the forestry
lands, wherever located, owned and maintained by the State University of
New York college of environmental science and forestry, or upon a school
bus as defined in section one hundred forty-two of the vehicle and
traffic law, without the written authorization of such educational
institution; or
(4) He possesses a rifle or shotgun and has been convicted of a felony
or serious offense; or
(5) He possesses any dangerous or deadly weapon and is not a citizen
of the United States; or
 
Would driving to a free state for the day be an option? Pennsylvania is close enough for a day trip to the range, no firearms licenses at all, and as far as I can find there is no restriction on non-citizens using firearms at a range. Anyone with more knowledge of PA law, please chime in.

As long as the cousin does not handle the firearms while in NY, he shouldn't be in violation of any laws.

Make a trip to Pennsylvania if New York won't let him. We had a person from Germany shooting with us in IDPA events at our gun club. He was here for about a year if I recall. PA has no such worries.
 
How far are you from Manchester, NH? There's a range there that will rent you handguns and SMGs without a hassle. Live Free or Die.
 
I live and shoot in NYS. I am a NYS pistol license holder. I take other people shooting my pistols all the time, and have actually done so while sharing the range with police officers.

There are no handgun-renting ranges that I know of in NYS, and most gun shops will ask to see your pistol license if you want to handle a pistol (notice I said most). There is also no real hard answer about whether you are doing anything illegal by holding a pistol without a license. If you wanted to get really technical about it, then I suppose that it would be illegal to look at a pistol in the store without that exact serial number being registered on my license. Not to mention the store clerk may or may not have a pistol license, so how is he supposed to take the gun out of the case?

The facts are that in NYS, this is not a valid worry, at least in my limited experience.

Long guns are another story. We have as much long gun freedoms here as anywhere else, aside from the standing AWB
 
If you read the NY state statute carefully, "trading guns" at a gun range and letting other people shoot them is only allowed between license holders. To let someone unlicensed shoot your gun at the range is illegal.
 
In the NY State Penal Law (where the above excerpt is from) "firearm" is defined as being a handgun (or the federally illegal weapons such as a short barreled rifle).

Long arms should be no problem.
 
If they are at a safe range and shooting responsibly then they shouldn't be worried. I never heard of anyone getting in trouble for letting someone else fire their pistol at a range. The permit holder is right there and is monitoring the shooter. They would have to be doing something unsafe or annoying to others to attract the kind of attention that would lead to the police showing up.

If letting the non-licensee shoot is a concern leaving them alone, even for a minute must be too. If you leave them alone to watch the gun while going to get a soda from the range vending machine, a forgotten piece of equipment in the car, or the rest room during that time the guns were in their possession.

We had lots of members who had pistol permits at our club and lots who didn't. If people were shooting and someone wanted to try something it was never a problem.
