.Troopers PBA: Hey, our members didn’t pass SAFE
Posted on April 15, 2013 at 5:28 pm by Casey Seiler, Capitol bureau chief in Guns

(Skip Dickstein/Times Union)The New York State Troopers PBA has released a statement expressing its hope that opponents of the SAFE gun control law will appreciate the fact that its members “did not write the terms of the bill nor vote on its passage.”

“Our membership holds widely shared concerns of this new law,” the statement reads in part. “Additionally, we believe that actual enforcement of these new regulations will significantly increase the hazards of an already dangerous job.”

Other law enforcement groups, including one representing deputy sheriffs in Saratoga County, have expressed their opposition to the law, which was passed in January less than 24 hours after being released for public view.

The statement calls out Assemblyman Dennis Gabryszak and state Sen. Michael Ranzenhofer, western New York lawmakers who have called for an official investigation into whether or not the State Police are sifting through medical records. The elected officials were reacting to the case of a Buffalo-area librarian who had to turn in his guns after being mistaken for a man with the same name. State Police and the Erie County Clerk have been pointing fingers at each other over that episode.

“Additionally, some in mainstream media have already irresponsibly increased the anti-police rhetoric, which fosters additional resentment of law enforcement,” the statement says, without identifying any reporter or outlet.

Here’s the full statement:

The NY SAFE Act has been a controversial and emotional topic since its passage in January of 2013. The NYS Troopers PBA, representing more than 6,000 active and retired members, has reserved public comment as we worked within the legislative process of NYS government with the hope of affecting changes to the law. Our membership holds widely shared concerns of this new law. Additionally, we believe that actual enforcement of these new regulations will significantly increase the hazards of an already dangerous job.

Polls have shown that increased firearm regulations are not popular in the more rural and upstate regions of our state, which is where the majority of our members live and patrol. Additionally, some in mainstream media have already irresponsibly increased the anti-police rhetoric, which fosters additional resentment of law enforcement. Even some of our elected officials, like Senator Ranzenhofer and Assemblyman Gabryszak, are calling for a probe of our members and their efforts to meet the standards of this new law.

It is the responsibility of this union to defend the reputation and safety of our members. Potential legislative changes as well as pending court decisions may further alter the terms of the SAFE Act. The individual members of this union did not write the terms of the bill nor vote on its passage. We urge the citizens of New York State to remember that Troopers are simply tasked with the lawful mandate to enforce the laws of the State, regardless of their personal opinion of such laws.

Reading the full statement is like remembering the old statement: The Beatings will Continue Until Morale Improves.

If enforcing this unconstitutional law will increase the job hazard; then the course of action for someone to follow is not that hard to discern.

So... They will refuse to enforce it? Perhaps they should include a link to oath keepers?

"NYS Troopers PBA, representing more than 6,000 active and retired members, has reserved public comment as we worked within the legislative process of NYS government with the hope of affecting changes to the law."

In other words, they are working to get themselves exempted. Thanks a lot guys.

If the law abridges the constitution, it is no longer lawful. There may come a time gentlemen (and ladies) where you have to consider that issue.

I have no skin in this game, but this looks like mendacity and finger pointing to me.

How exactly is this a bad thing? There was credible evidence that the NYSP at some level may have violated HIPAA privacy rights to gather information used proactively to disarm citizens. Yes, we know you did not vote for it, yes we know you may not like it much, but expecting us to turn our backs while you may have gone out of the way to proactively disarm people, that is just way too much to ask.

Hmmmm... Nazi Germany, the Nuremberg trials. "But I was just following orders!"

members “did not write the terms of the bill nor vote on its passage.”

They supported it's passage... until they realized they were not exempt and changed their positions. Then it was too late.

Next time don't support the gun grabbers.

Well, in reality, that is a Police persons job - to enforce government edicts.

We all know, here, that contrary to the sheeples belief, the Police have no duty to protect us (per the SCOTUS)

They didn't have to cajones to condemn the law, or take a stand on its viability, fairness, or even an OPINION on its constitutional legality. They did not want to offend the higher ups, and they didn't say they were going to use "discretion" in its enforcement. SO, they did say they were scared, hoped citizens would not become violent over it, and they would basically HAVE to enforce it, as that was their jobs, and they weren't going to give up their jobs over this particular law. I like the western sheriffs' declarations MUCH better.

Funny, I find myself sadly lacking ANY compassion.
they had their chance, they refused to address it, now they reap the whirlwind
they don't like, well, they can deal with it.

first of all the state police do not have a dangerous job. second all police unions are to the left of Stalin. state police have set up a $500 reward for ratting on a "illegal" firearm have set up sting operations to arrest guys selling private guns and will take the registration of banned guns. they could at least refuse to handle the registration on the guns. police have earned any anti police feelings

Bad reaction from the Union.
Now at what point do they inform the State that this isn't going to happen? Think about if it was another issue concerning the lives of Officers in a matter of Safety. I think the reaction might be a Walk-out if it was serious enough.
This shows the Union is particularly weak when confronted by political pressure.....as long as it is P.C. Politcal pressure.

police always hide behind the worn out statement we do not make the laws. hey buddy if the other commie politicians did not make 60000 laws a year you would not have a job so they are in on it also
