FLASH: Ohio Senate passes SB239 (Restaurant & Car Carry Rules Fix) and SB247 (Restoration of Rights)

The Ohio Senate has passed Senate Bill 239, which will allow citizens who hold a valid concealed handgun license (CHL) to carry a firearm in restaurants. To do so, license holders may not consume any alcohol and must not be under the influence of alcohol or drugs. According to OpenCarry.org, 42 states (including every state that borders Ohio) allow non-drinking license holders to carry firearms in restaurants.

The bill also reduces burdensome restrictions regarding how a license holder must transport a firearm in a car. Currently, Ohio is the only state to place such complex limitations on license holders.

The Senate also passed Senate Bill 247, which seeks to align Ohio law with federal statutes regarding the restoration of rights to Ohio firearms purchasers.

Ken Hanson, Legislative Chair of Buckeye Firearms Association, said, "These bills addresses three important issues facing Ohio gun owners and concealed carry license holders and seek to align Ohio law with federal law and the laws of our surrounding states."

Having passed with a 23-10 margin in the Senate, SB239 will now be taken up for consideration in the Ohio House, where the House Public Safety and Homeland Security committee has already held several hearings testimony on the House's version of restaurant carry (House Bill 203).

Likewise, SB247, having passed with a 23-10 margin in the Senate, will also now move to the Ohio House for consideration.

Senate vote tallies will be posted here when available.

Buckeye Firearms Association strongly urges the Ohio House expedite passage of these bills, and to send both to Governor Strickland before the summer recess.

Are the House and Governor expected to fall into line?
 
Surprisingly enough, Gov. Strickland (dem), is more gun friendly than Gov. Taft (rep) was. Taft vetoed the concealed carry law when it passed, but there were enough votes in the house and senate that they overrode his veto.

It's about time they took some of the confusion out of the Ohio CCW laws. They still have a ways to go though.
 
We have the same thing going on in Tn. Our glorious governor vetoed our restaurant bill. I do believe we have enough senate votes to over-ride it. I don't see the difference between carrying in a McDonalds or a Ruby Tuesday as lomg as you're not consuming alchohol.

The Speaker of the Ohio House, Armond Budish, is no friend to gun owners. He has an NRA rating of "D".

This bill will die in the House unless Ohio gun owners contact their state representatives and demand that Budish allow the bill to go forward. Asking Gov. Strickland to apply pressure to Budish might also help.

P.S. The Ohio FOP, the Buckeye State Sheriffs' Association and the Cleveland Patrolman's Benefit Association have all come out against this bill.

I received a join/donation letter from the BSSA several weeks ago.
I called the local Sheriff, good friend, and he advised that he would see none of the $$.
I threw it away. Now I see where the money is going, and it ain't helping us!

Senate Bill 239, which recently passed the Ohio Senate 23-10, has stalled until after the summer recess thanks to a procedural maneuver in the House to stop a vote.

Representative Danny Bubp had intended to add the language from SB 239 to another bill as an amendment but Speaker Armond Budish called a vote on the bill before the amendment could be offered. Bubp, one of the primary supporters of HB 203, a similar measure introduced in the House, predicted the amendment would have passed had it been added.

"It would have passed, no doubt in my mind," Bubp said. "If someone goes into a restaurant and gets hurt because they can't defend themselves, I'm going to be the first to say we should have done this."

Sen. David Goodman was one of the few Senators who voted against the measure and believes it will lead to violence despite the fact that Restaurant Carry is legal in 42 states, including every state surrounding Ohio.

The Democrats control the Ohio House and they have it stuck in committee. Don't hold your breath waiting for this to pass.

Governor Strickland needs gun owner votes to be reelected. Email his office and remind him of that. I did.
 
does anyone have any thoughts on where this is going to go now that the election is over?
