A second suspect in a convenience store robbery is on trial in the death of his partner, who was shot during the robbery by the owner of the business.

An Oklahoma County jury began hearing witnesses Tuesday in the first-degree murder trial of Dewayne Cedric Lee Shirley, 19. He is accused in the Nov. 8, 2000, shooting death of Teron Armstong, 16, during a robbery at Tran's Food Mart, 3710 S May Ave. Han Van Vo, the owner, fired seven shots at the robbers, killing Armstrong.

Retired District Attorney Bob Macy ruled the shooting was justified and refused to file charges against Vo.

Instead, Shirley and Kenneth Ray Kinchion, 21, members of the Oak Grove Posse Crips street gang, were charged with Armstrong's death.

Kinchion was convicted last year and sentenced to prison for life with the possibility of parole plus 120 years.

Shirley also faces two counts of conspiracy to commit a felony - robbery - with a dangerous weapon, two counts of a convicted felon in possession of a firearm and one count of robbery with a dangerous weapon.

Shirley is accused of two robberies on the same day. The other was at Coker's Corner, 2301 S Kentucky Ave.

Testimony is expected to continue today before District Judge Susan Caswell.

Defense attorney Larry Tedder told jurors Shirley wasn't there because he spent the day with his brother and most of the evening with his girlfriend.

"When all is said and done you won't be able to tell Dewayne Shirley did anything," Tedder said in his opening statement.

Assistant District Attorney James Siderias told jurors: "They thought that they had the perfect set-up. They had gotten away with a robbery earlier in the day.

Jurors watched two video surveillance tapes from Tran's Food Mart as Vo testified about the three men who robbed his store and how he killed one of them.

The victim testified he had a .357-caliber Magnum revolver on his belt as Armstrong jumped over the counter, demanding he open a safety box where additional money was kept.

He said he repeatedly pulled the trigger during the incident.
