Permit troubles in MA

A friend of mine (I know, but it is true - it isn't me, and why would I lie when I'm faceless and nameless?) is having trouble getting his LTC renewed, and I'm wondering if anyone has heard of anything like this and may have some info or insight.

He moved to Hudson and applied for renewal of his Class A LTC - all lawful purposes - which was granted in one of the larger cities in MA. Denied - for misdemeanor offenses that had no convictions which occured prior to his being issued the original license. Stupid drunken human tricks, no real record except the arraingments - as far as I know, both were continued without finding, he grew up and got a license to carry with no problems with the prior arrests.
The district court judge ordered that he be reissued his license, since he is not a danger to society and hasn't been in trouble for years, and only the minor BS ones (two of them) at that. The police chief appealed the judge's ruling on the day that my friend was to be allowed to get his permit, and was turned down. The chief is now appealing to have the case brought to Superior Court to have my friend's license revoked.
Has anyone ever heard of anything like this? OK, my friend isn't an angel, but even the judge (a Massachusetts judge!!) feels he is stable enough to have a gun.
Is the Hudson Police Chief just a $#% or what?

My friend has sent off emails asking for help to GOAL, NRA and the ACLU. Any ideas of anything else? Thanks.


Good news (for me anyway) is that I still get to keep his guns while he can't have a license! I'd like to have to think of another reason to not give them back, since they are very comfortable in my safe, but at least they aren't homeless or in a shelter.
 
Just one of the disadvantages of living in a nanny state after citizens abrogate their rights.

Yes, tell your friend to move to another state, or at least move out of that town.:) If the State Police background check did not disqualify him from a LTC, then the Chief Law Enforcement office is using your friends old priors to deny your friend a LTC. As you know in Mass the Chief Law officer has the right to restrict issue of License To Carry, class A and B. Some towns will not give out any LTCs permits. The Ninny, I mean the CLO, is in compliance of the law, even if unfairly. I don't believe district judge can force a CLO to issue a license. Your friend does have a way to try to circumvent the CLO, through the State License board. He will probably need a lawyer who is knowledgeable about MA firearm laws. GOAL can help him find a good lawyer.
 
good luck getting help from the aclu--they conveniently have decided not ALL constitutional rights are equal...

Nonsense. The court overturned the chief's decision and ordered the license to be issued. Defying a court order is hardly "compliance of [sic] the law."

Three strikes; you're OUT! The FLRB has NO jurisdiction over appeals and NO jurisdiction where, as here, there are no convictions.

I live in Mass, unlike you and I know the law well enough to advise someone to obtain legal help. No I am not a legal expert, and never stated I praticed law in MA.

Obviously not. You've misstated the legality of a chief's actions in refusing to issue a license per court order, authority of the court to issue such an order and the jurisdiction of the FLRB - which you are too ignorant to even identify correctly. :rolleyes:
