If you buy from an individual (a guy who is just a regular guy, not a gun dealer) is it a simple cash transaction between two private citizen?

OR, do you have to report the sale to the ATF or some other government agency?

Just curious what the deal is when you buy from a private individual.
 
Depends on the state, the gun, and if you're both citizens, I believe.

In a State like CA, I think all firearms transactions between people need an FFL to handle the transaction and a DROS to be sent to the DOJ.

In PA, I believe you can transfer long guns between two parties that are both PA citizens without using an FFL.

Don't bet your freedoms on it though, and research your state laws first.

With handguns you almost always have to use an FFL though, unless it is Spouse-Spouse or Parent-Child.
 
Thanks for the link. I'll go read up and see what I can find for my state, Texas.

I've always heard in Texas you can buy from private individuals but maybe that's changed, I don't know.
 
When buyer and seller do not live in the same state, the seller usually sends the gun to a federally licensed dealer near the buyer. Here's how it goes:

1 - The buyer sets up an arrangement with a nearby licensed dealer;
2 - the dealer sends the seller a copy of his license;
3 - the buyer sends the seller the money; Steps 1, 2, and 3 happen all at once - usually on the same day.
4 - the seller sends the gun to the dealer after he receives the money and the copy of the license;
5 - the buyer visits the dealer to pick up the gun, fill out the paperwork, do a NICS check (a phone call background check on the buyer) etc., pays a fee for the paperwork, and goes home with the gun.

I've done it at least 100 times. Never had a problem - smooth as silk.

I thought anything to do with guns was regulated by the feds.

I guess I'm going to have to hire a lawyer to research whether I can legally buy from a private citizen in my own state just so I can be sure I'm not violating any state laws.
 
a FFL is a dealers license... an 03 C&R FFL is a curio and relic collectors license... neither are required to own a firearm...

as for private sales ... depends on the state... in NC for example, its 100% legal, though the buyer must have a pistol purchase permit or a CCH permit to recieve a handgun...

probably not any need to call a lawyer, just call your local gun shop and ask em about it...
