Replacement Gun from CZ - to an FFL?

CZ is sending me a replacement for a malfunctioning handgun. Since it's a new gun with a new serial number, must it be sent to an FFL? Or can it come back to me as if it were the repaired model?

I am almost positive that it has to go to the ffl or it will be unregisterd

New serial number = FFL + 4473 and NICS check. It has nothing to do with "registration" unless state law requires registration of handguns.

If they destroy the original gun and make a new one with the same serial number, then they can ship directly to you.

As long as you shipped the gun directly to CZ for repair (did not have your dealer ship it for you) they are allowed to send a replacement directly to you.

I did send it to CZ. I wonder if they will be able to issue the same serial number. The thing is that I may be receiving a P01 to replace a RAMI (they offered both, I opted for the P01).

I purchased one of the first Redhawks in 45 Colt wanted to replace the rear sight couldn't do it holes for the screws where off center. Returned it to Ruger they had other problems with the pistol ended up with a new pistol sent directly to me.

From the ATF FAQs:

"A firearm is delivered to a licensee by an unlicensed individual for the purpose of repair. Is the return of the repaired firearm subject to the requirements of the Brady law? Would the transfer of a replacement firearm from the licensee to the owner of the damaged firearm be subject to the requirements of the Brady law? "

Neither the transfer of a repaired firearm nor the transfer of a replacement firearm would be subject to the requirements of the Brady law. Furthermore, the regulations provide that a Form 4473 is not required to cover these transactions. However, the licensee’s permanent acquisition and disposition records should reflect the return of the firearm or the transfer of a replacement firearm.

Gator has it right on a Federal level.... however, state law may have further regulations/laws on the matter.

For example: In NY to possess a gun, it must be on your license.... if it is the same make/model/SN then no new paperwork need be done and it can go directly back to you. However, if there is any change in make/model/SN then it must go through an FFL and be placed on your license by the county pistol clerk.....

We don't what state you are in, so that could make a difference.
