Caveats:
The Civil District Court for Orleans Parish is closed until October 1.

The plaintiff needs to be a person whose guns have been confiscated. A threat to do so might be good enough, but it would be better to find a person whose guns are gone.

You are going to need a lawyer. When you file this you will be met with a bunch of exceptions and defenses; the response to these is something that is beyond the scope of something as simple as a post on an Internet forum.

The attached file was created in Word Perfect and saved in ASCII (DOS) Text. It may need some formatting.

Nice start. Let's hope someone can do something with it when the courts open. Pending that, is their another court jursidiction that this can be filed while NO get's it stuff back together?
 
In my humble opinion, a noble but foolish gesture, and a total waste of time. No sympathy will be found in the courts on this one.

I disagree. It's long known that decisions made in the heat of the moment will be judged at leisure by a court. Judges and courts have a heavy investment in the idea of the rule of law. NOPD is operating as a criminal gang right now. The city of NO itself may be corrupt, but Federal courts have authority over it, and Federal courts are not corrupt (at least not in the sense that NOPD is corrupt).

No martial law has been declared. Even if martial law HAD been declared, there's nothing in martial law that allows for confiscation of firearms. The law on this is very clear. It has been shown time and time again that saying, "well, your honor, you gotta understand what we were going through, blah blah blah" doesn't get you anywhere in court.

"Yeah, well, I shot my wife, but your honor, you gotta understand, she just would not stop nagging me, she was running up credit card bills, she had sex with the cable guy, so yeah, I shot her, but you understand what I was going through, right?" That is NOT a defense. That gets NOWHERE.

Look - if you don't play the game too and use the system we all talk about defending to fight what they do, you are loosing the point. It is not a point of anarchy right now.

I really hope MANY NO people who had this done all pile together and a legal defense fund is put together, and legislation is placed in. I know a lot of you glass half-empty types will disagree, but you must fight on ALL fronts.
