SBR lower question

I'm fixing to build an SBR in .300 blackout and have a receiver question. I currently have a Spikes Tactical lower and want to use that for the SBR paperwork. Can I do so or do I need to purchase another lower and have that listed on the 4473?

I'm going to e-file with my current trust that also has my suppressor on it so hopefully the wait won't be too long.

You can use any rifle or lower receiver you own.

What is listed on a particular 4473 is irrelevant, a 4473 is a record of a firearm transaction by a licensed dealer.......it's not gun registration.
 
Whatever lower you choose, it is the only one allowed in the SBR configuration. It can be one you've owned for years or be brand new.

Last question, on my "Assignement to" page of the trust, should I just list the lower that will become the SBR or should I also leave my suppressor information on there too before submitting to the e-file website?
 
I would leave the suppressor info there too myself. Though one dealer told me the schedule should be blank, which makes no sense to me.

Your can should not be on the schedule prior to approval because the trust can't posses it until the paperwork clears. So if its your first NFA item the schedule could be blank, although some states require something initially to "fund the trust".

If your first NFA item is a gun to make into an SBR, it needs to be on the schedule as has to be Trust property, not yours when you fill out the form.

When my lawyer drew up the Trust I had him add all the guns I'd planed to SBR eventually, of course more were added :) I added the suppressors once I took possession for the Trust.

If your Trust has possession of the suppressor (approved form 4) then it should be listed on the schedule along with the gun to be made into an SBR.

That's why you leave the date blank or pending. It does help the ATF if they misplace a page or two of your trust, because they can look up another transfer. (That part is hearsay).

I have listed assets not yet owned on the trust for each of several form 4s and it's never been an issue.
