SCOTUS update on Drake v. Jerejian?

It looks like it granted these 3 cases: The Court has granted three new cases: Heien v. North Carolina (13-604), Zivotofsky v. Kerry (13-628), and Johnson v. United States (13-7120).



Did SCOTUS not grant cert on Drake v. Jerejian?


What happens with that case now?

As I understand it there has to be an order denying or granting cert. If there is no order denying it is put back into rotation. Heller was put back into rotation and then they chicken picked out of it what they wanted to deal with. Hopefully this means at the next conference it gets granted.

Update came out:


I don't know if this means they didn't discuss it last Friday or if they did and are just putting off making a decision to grant cert. I don't know if this is good or bad. I guess it can't be horrible since they could have denied cert and ended it right there.

Supreme Court pushes consideration of N.J. gun case to April 25

The U.S. Supreme Court has pushed its consideration of a case challenging New Jersey’s mandate that citizens show a “justifiable need” to carry a gun in public for protection to April 25.

The case — which involves John Drake, who runs a Sussex County business that owns and services ATMs, as well as other plaintiffs — had been scheduled to be heard in conference on Friday. But it was not listed on an order list of cases the court has agreed to hear and those it has denied that was issued on Monday.


An updated schedule for the case released Monday by the court says that it’s been distributed for a private meeting among justices on April 25.

I'm guessing that the Supreme Court is waiting to see what the 9th circuit will do with Peruta vs. San Diego. Peruta and Drake are the two opposing circuit court viewpoints, but Peruta can be overturned if the 9th reverses the three judge panel with an en banc review. Then again, there's still the 7th circuit decision in Moore vs. Madigan, but Illinois had an outright ban on carry. NJ at least has a "scheme" in place for CC.
 
Come on, guys.

There's no way to know why the Supreme Court Justices do, or not do, in their Friday conferences, and there's no way to know whether they will or will not grant certiorari until they announce it.

We'll know about Drake on Monday, even if all we know is that it's kicked over again. Until then, we're just guessing.
