Selling hand gun

Hey all,

I'm sure that this is a question that has been answered before, so if some could direct me to the right thread...
I am planning on selling a hunting handgun through the forum on this site, but am a little confused by the legality of it. I live in VA, is it legal for me to ship directly to another individual, or do I have to go through a dealer?

Federal law says you must not tranfer any firearm to a citizen of another state without going through an FFL dealer.

As the gun is a handgun, the transfer must be done at a dealer in the buyer's state. (If it was a rifle or shotgun the buyer could purchase it at a dealer in your state.)

By federal law, also, you may ship the handgun directly to a dealer in the buyer's state. However, some dealers will not accept this and require that you have your local dealer ship it to them.
 
C'mon Sam, let's give'em BOTH sides of the coin.

Since the OP didn't specify whether the buyer was a fellow Virginian or not, the federal law says a person can have any legal firearm delivered directly to a same-state resident (this is how FTF sales are legal). "Directly" means just that - no FFL involvement.

Nothing in the law prevents one from using an FFL's services for an intrastate transfer, but their services are not legally required, so long as the seller follows the laws for any transfer (not knowingly selling to a prohibited person, etc).

Thank you. Yes, I made the assumption that this was going interstate and that might not be the case.
