The rational is “Would a reasonable person be in fear of death or bodily harmâ€.
Always ask two questions. 1. Is the threat direct? No physical barrier between you and the assailant or can be placed between you and the assailant [door, window, wall etc]. 2. Is the threat overt? Display of weapon, verbal communication, physical movement etc. If the answer is yes yes, double tap. One pull for each correct answer.

This is the correct answer. All of the speculation as to what is in the syringe, and whether to believe the guy, is really a waste of time. Let's change the situation just a little: He's threatening you with a gun, not a syringe. The presumption HAS to be that the gun is loaded. Maybe with FMJs, maybe Hydra-shok, maybe semi-wadcutters, maybe old ammo that won't fire, maybe with depleted Uranium and maybe with blanks - it doesn't really matter, no one is ever going to have a chance to examine them, any more than you'll get the chance to run tests on the fluid in the syringe. Even if the syringe is empty, and the air-bubble thing is not a factor, you could be stabbed in the eye with it, rendering you helpless with pain to whatever else he wanted to do to you.

This is an easy question to answer. The simple fact is that you are dealing with a potentially deadly weapon, wielded by someone who is credibly and openly threatening you with grievous bodily harm or death, and who is in a position to actually carry out the threat. SHOOT!

I maybe mistaken, but isn't there something at the hospital they can give you within the first 24 hrs. of contracting aids that kills it most of the time?
 
That would be incorrect. Your blood is circulated a lot faster than that. The cells infected with HIV/AIDS would already be all over your body. Once its in you, you are done.

People have been charged with armed robbery simply for holding their fingers in a pocket and claiming they have a gun. How is someone else supposed to know if you are lying or not?

I would shoot provided I felt my life was actually in danger. Whether or not I felt that way would depend on the situation and circumstances.

Yeah, sorta. If you know you've been infected, docs will start you on a pretty wicked anti-retroviral cocktail that will (hopefully) keep you from converting. Mom worked in the HIV clinic at Parkland, and got cut last summer. The investigation determined that the cut was from a piece of sterile equipment, but she still had to take some really unpleasant drugs for awhile.

It all depends on just how you're infected. Blood from a patient with a low viral load, and an exposure from a cut or a needle stick, you're looking at something like a 1/100 chance of converting. Try it with a needle full of blood, with a high viral load... the odds suddenly aren't so good.
