I'm currently traveling through South Carolina. In other travels, I've had no problems buying long guns in Arizona, Virginia, North Carolina, and Alabama. However, this time, the gun shop owner told me that he couldn't sell any gun, even long guns, to someone from Florida. He said that South Carolina law listed seven or eight states that he can't sell to, and Florida is one of them. I've never heard of such a thing! Is he right or wrong?

Sure, Obama is pro-gun, just like he's pro-life!

Hmmm.... I thought you couldn't buy guns directly anwhere except your home state... I mean, sure, you could buy one out of state, and have an FFL transfer done to get it back to your state...

That said, never heard of a "special" law here that prohibits FFL transfers... but then again, I have no experience in this area.

I believe he's simply wrong. From the South Carolina code ...
SECTION 23-31-20. Purchase of rifle or shotgun in this State by resident of any state.

A resident of any state may purchase rifles and shotguns in this State if the resident conforms to applicable provisions of statutes and regulations of this State, the United States, and of the state in which the person resides.

I keep a pretty close eye on gun related bills in the South Carolina legislature and I'm not aware of any that would have any effect on this.

Did I look like a scondrel?

I don't think so... I had a coat and tie, but I never look all that professional all gussied up. Maybe it was that old beat-up car I was driving. It looks like something dragged off a wreaking yard, but it's paid for, runs real good, gets 34 MPG, and the air conditioner will freeze you out.

Anything not worth doing well is not worth doing at all.

I'd like to know the name of the store also.
And I think the gunshop owner is mis-informed.....:uhoh:

Yoda this seems to answer the question from ATF,FAQ site.

(B2) From whom may an unlicensed person acquire a firearm under the GCA?

A person may only acquire a firearm within the person’s own State, except that he or she may purchase or otherwise acquire a rifle or shotgun, in person, at a licensee's premises in any State, provided the sale complies with State laws applicable in the State of sale and the State where the purchaser resides. A person may borrow or rent a firearm in any State for temporary use for lawful sporting purposes.

[18 U.S.C. 922(a)(3) and (5), 922(b)(3), 27 CFR 478.29 and 478.30]

So,if SC and your state laws allow it,you can make the purchase through a SC FFL.

Which Store?

It's the one just down the road from the main gate at Shaw AFB, between the base and the town of Sumter. I can't recall the name, but as you're driving towards town, the store is on the right and the base's perimeter fence and the wooded area are on the left.

You'll never get rich working for someone else.

I purchased a rifle on sale from bass pro shop in north myrtle beach 3 years ago with no problems. My primary resident is in n.y.s.

Print out and take to him the section of the law that I sent the link for. It is rather obvious that you can buy a rifle from them. If he still doesn't want to sell you the gun, then find another shop. And be sure to tell everyone at the base about this store.

Yoda,
Just keep driving towards Columbia. Wateree Firearms will be on the left about half way to Columbia. Now they are a bit pricy, but a decient selection. Or come on into Columbia. Shooter Choice, Lexington Pawn and Gun, Sportsmans Warehouse, Palmetto Firearms, Lawmans Supply, Best Deal Pawn and Gun...We have a few choices.
BTW, is that ratty old car for sale?? :D

A number of states have NOT changed their laws form the older 'adjacent state' rule to the new federal rules.

That is Tony's Gun Shop. They're a bit odd but decent folks. They want to be more of a cop shop than a general gun store. Agreed with trying Wateree Arms up the same road towards Columbia. There on the left with a deer stand out front. Talk to Steve. Good reasonable man.

Excellent point. The apparent Florida statute was found here and reads ...

790.28 Purchase of rifles and shotguns in contiguous states.--A resident of this state may purchase a rifle or shotgun in any state contiguous to this state if he or she conforms to applicable laws and regulations of the United States, of the state where the purchase is made, and of this state.

That looks like Georgia and Alabama are your only choices. The South Carolina statute here is similar and would appear to limit my out-of-state purchases to Georgia and North Carolina. It reads ...

SECTION 23-31-10. Purchase of rifle or shotgun in contiguous state.

Any resident of this State including a corporation or other business entity maintaining a place of business in this State, who may lawfully purchase and receive delivery of a rifle or shotgun in this State, may purchase a rifle or shotgun in a contiguous state and transport or receive the same in this State; provided, that the sale meets the lawful requirements of each such state, meets all lawful requirements of any Federal statute, and is made by a licensed importer, licensed manufacturer, licensed dealer, or licensed collector.

BUT, these statutes appear to make it lawful to purchase a long gun in a contiguous state. Is there a statute, in either Florida or South Carolina, that makes it unlawful to purchase a long gun in a state that is not contiguous? According to the post by Duke Junior above, looks like federal law expressly allows it, so if state law does not disallow it it should be OK, no?

Keep driving right on past Wateree Arms. They have ridiculously high prices and have called me a liar on two separate occasions. The one that angered me the most was when I was looking at a gun and told them I was coming back a few days later to buy it. Before I came back, they raised the price by $60 then called me a liar when I advised them that was not the price on the tag two days earlier.

I really don't know how they stay in business.

They are a VERY wealthy family. he gun shop is a hobby for the son that was injured (severe back injury) on the family farm. I usually keep driving by when I'm going that way because of the reasons you posted. Never had an experience as you described, but get a real uncomfortable feeling when I'm in there. Hard to describe.

I DID try to stop at Wateree Arms...

They were closed.

Now I'm spending the night (Friday) in Atlanta, will have Saturday lunch in town with my son, then on to Eufaula, Alabama, for Saturday dinner with my wife and stepdaughter (wife is helping care for the daughter, who is between surguries), then sleep Saturday night in our family home in Fort Walton Beach, Florida, then Sunday lunch with a grandson who is in the hospital in Pensacola, then back to Tampa late Sunday night/Monday morning so I can go save the world at 0800 hrs Monday morning.

I probably won't have time to stop by gun show in Pensacola this weekend, or any of the others that will be going on along the way.

Next weekend with other grandkids in Melborne, then a quick trip to Wyoming and then Kansas City, then over to Qatar for a business trip.

I hope to get the time to sleep in late some time in mid-October...
