I just wrote my state senator and state representative, asking them to introduce a bill moving switchblades from the "prohibited weapons" category to the "illegal knife" category. Currently switchblades can only be owned as a curio or an antique in Texas. Moving them into the "illegal knife" category would make them completely legal to own and would allow them to be carried in certain circumstances. I would like to see them legal to own and to carry, but one step at a time. Please write your state senator and state representative if you agree with this idea.
 
Personally I agree with Lawdog that Switchblades are not great weapons.

And I really don't want to carry one because my main goal in life is to "stay out of" or "get out of" fights as fast as possible and switchblades seem to be a "stay in a" fight kinda weapons (please note that I did not say GET in a fight).

But what the heck. Maybe you are better with one than I am. I do remember reading something about "the right to keep and"... something... it was something about having our rights not taken away with regard to weapons. Anyway, sure. Will do.
 
Well I am no fan of Knife fighting, and I think knives are a poor self defence choice. However they are a handy tool, especialy one handed.
Why noy make them legal as any inanimate object.

Same reason there is a bias against Tec-9's. They were favored by gangs when the law was passed. Ever see West Side Story?

Only a criminal would want a gun that holds more than 10 rounds.
Only a criminal would want an 'assault rifle'.

There was simply no one there to fight the passage of this one.

Whether or not they are useful or good weapons is beside the point.

Because they will lead to bad singing and dancing. Didn't you see West Side Story?

They have always been associated with punks and sneak attack styles of combat. Besides the cool factor, they really aren't a good weapon IMO. Still, they should not be banned.

Your 5 inch folder is a much better weapon than the average switchblade. Any reasonable amount of practice will let you open a folder up as fast as a switchblade with out all the complicated and sensitive mechanism.

I don’t think they will ever be made legal, unfortunately, because of the style of fighting they are associated with and lend themselves to.
 
One of the things that you have to find out is if any knife companies in TX made switchblades.

Even if it's not covered by state law they are covered by federal law under the interstate commerce act (IIRC).

I believe that is why they are allowed to be bought and carried in states like oregon and florida via state law but they, the companies, can't sell them to anyone out of state.

As for the topic, wasn't there some exclusion on a Federal , maybe state, level for handicapped folks?

I can swear I read of an exclusion for folks that had limited use of a hand or arm etc for a switchblade but it's been a while.

TEXAS PENAL CODE
TITLE 10. OFFENSES AGAINST PUBLIC HEALTH,SAFETY, AND MORALS
CHAPTER 46. WEAPONS
(6) "Illegal knife" means a:
(A) knife with a blade over five and one-half
inches;
(B) hand instrument designed to cut or stab
another by being thrown;
(C) dagger, including but not limited to a dirk,
stilletto, and poniard;
(D) bowie knife;
(E) sword; or
(F) spear.
(11) "Switchblade knife" means any knife that has a
blade that folds, closes, or retracts into the handle or sheath, and
that:
(A) opens automatically by pressure applied to a
button or other device located on the handle; or
(B) opens or releases a blade from the handle or
sheath by the force of gravity or by the application
of centrifugal force.

I'm with DR. Make all knives legal. The Texas knife code, like many gun laws, is based on nonsense and fear-mongering. Sort of a Texas knife version of the AWB.

Any incarnation of the Bowie knife is illegal fer cryin out loud. In Texas. Home of the Alamo. Jeez. :cuss:
 
Strangely enough, an "illegal knife", such as a Bowie knife, is perfectly legal to own, but generally illegal to carry, since an "illegal knife" is an "unlawful carrying weapon".
 
Yeah, I have several 'illegal' knives. One is a WWI trench knife - the kind with the brass knuckles and stamped with 'U.S. 1918' on the handle. I believe mine is a French knock-off. It occupies a spot in my safe along with several bayonets that my Uncle collected over the years.
