Some of you may remember a very controversial shooting by a Texas CHL holder that was discussed here at THR.

The CHL in that scenario received a 40yr prison sentence. However, just this past December 2014, he successfully appealed his case in the First District of Houston Court of Appeals.

The court ruled that the jury was given improper instructions as to Texas law regarding whether the CHL holder failed to properly conceal his handgun prior to the confrontation. As a result, Rodriguez (the CHL) will receive a new trial.

Was this the case where a guy claimed he was covered by the "Stand Your Ground" law even though he was trespassing on someone else's property at the time?
